.. ~ ~~p~\c. ~J~.~e~enr`~i ~eceys`"~ <br />Special Stipulations Associated _ <br />with the Of Lice of Surtace Mining <br />Approva ermit No. - <br />The Office of Surtace Mining attached twenty one Special Stipulations to their <br />approval of the Eckman Park, Mine 1 and Mine 2 permit to mine. A few of these <br />stipulations remain in the most recent Finding Document, and we assume that <br />those stipulations which do not appear in the most recent Findings Document <br />have been resolved. In some cases, however, we cannot find definitive <br />documentation of final resolution. Therefore, we request your assistance in <br />completing the files pertaining to these stipulations. The stipulations are <br />listed below: <br />Energy Fuels Corporation Special Stipulations <br />~ 1. The applicant shall amend the blasting form to include directions to the <br />nearest building or occupied structure. A copy of the revised form must <br />be submitted to the regulatory authority 2 weeks after mine-plan approval, <br />/2. The applicant shall relocate an existing air quality monitor or install a <br />new one south-southwest of the Eckman Park mine area prior to <br />commencement of mining in that sector. , <br />t/3. The applicant shall provide, by July 14, 1980, statistically valid <br />vegetative information associated with the soil type of the elk calving <br />ground, (soil type x8D). The information must include production, cover, <br />and diversity of the area. A dissimilarity statistical analysis shall be <br />performed to demonstrate differences between the aspen communities on <br />other soil types in the mine plan area and communities on soil type x8D <br />in the mine plan area. <br />~4. Within 2 months after the submission ofi the above-requested vegetative <br />information required in special stipulation 3, the applicant shall <br />provide to the regulatory authority a detailed description of <br />methodologies and criteria used in establishing new calving areas. The <br />applicant must also provide with this submittal a detailed description of <br />a monitoring program to evaluate the success of the new calving area. <br />~ 5. Six months otter approval, the applicant shall submit for approval of the <br />regulatory authority, a narrative of the techniques and devices to be <br />used to establish the necessary watering areas for e]k. The plan shall <br />also include a map showing the location of the watering areas in relation <br />to the elk calving grounds. <br />V 6. Every o months for the lite of the mine, the applicant shall provide data <br />collected during elk monitoring programs to the regulatory authority. If <br />it becomes apparent through monitoring of elk movement that haul roads <br />are interfering with migration of the elk, the applicant shall use <br />tenting approved by the regulatory authority. The fencing shall be <br />employed to minimize impacts of roads during migration periods. <br />-8- <br />
