<br /> <br />Stipulations 1, 2, ana 3 are active stipulations, and they are attached to the <br />current permit number C-81-071. (NOTE: Stipulations 1, 2, and 3 were Special <br />Stipulations l7, 18, and 19, respectively.) <br />Stipulation 4 (Special Stipulation 8) is now incorporated as part of the <br />C-81-071 permit text. <br />Stipulation 5 (Special Stipulation 10) was not carried to the current <br />aocument: however, we cannot find specific documentation that it was <br />definitively resolved. Please check your files for such documentation. This <br />will be added to the current permit to ensure that all vegetation monitoring <br />is posted in upcoming annual reclamation reports. (Also see comment in the <br />Special Stipulations Section of this findings) <br />Stipulation 6 (Special Stipulation 6) was specitically resolved with a <br />Division letter from Gan Matthews to Terrel Johnson dated March 13, 1986. <br />Stipulation 7 (Special Stipulation 7) is now incorporated as part of the <br />C-81-071 permit text. <br />Stipulations 8, 9, ana 10 (Special Stipulations 14, 15, and 16, respectively), <br />were not carried to the current permit; however, we cannot find specific <br />documentation that they were definitively resolved. Please check your files <br />fior such documentation. (Also see comments in the Special Stipulation Section <br />of this findings). <br />Stipulations Associated with <br />the Current Permit Number C-81-011 <br />The current stipulations are listed below. The numbers shown below are those <br />that were assigned during the first permit term, and retained subsequent to <br />the last renewal, We will probably assign a more reasonable number sequence, <br />once the issues aiscussed in this section are completely resolved. <br />/1, If, during mining cperations, previously uniaentified cu]tural resources <br />should be discovered, the operator shall immediately cease operations <br />within the vicinity of the site ana notify the regulatory"authority <br />(MLRD). Operations shall not resume until OSM, the land managing agency, <br />ana the State Historic Preservation Officer have had adequate opportunity <br />Lo assess the cultural resource. Mining operations shall not resume <br />until appropriate mitigating measures have been developed, approved by <br />the Division and implemented. <br />J 2, No lama aisturbing activities shall take place within l0U feet of the tvo <br />known graves on the permit area. <br />/3, The operator shall keep the fence surrounding the Foidel Canyon School in <br />good repair, No land aisturbing activities shall take place within this <br />fenced area ana the operator shall insure that the two structures are not <br />vanaalized, <br />-15- <br />
