No land disturbing activities shall take place within this <br />fenced area; and the operator shall insure that the Cvo structures are <br />not vandalized. <br />/4. The applicant shall seed all disturbed areas that have received final <br />topsoil preparation during the first normal planting period (fall). The <br />applicant shall not delay seeding for the purpose of establishing a mulch <br />~,(/ cover Crop. <br />~KJ 5. The results of interim stuoies of soil and vegetation conditions on <br />revegetated area, identified on page 816-161 (a) of the mining and <br />reclamation plan, shall be incorporated into the annual report following <br />data collection (every 3 years). <br />6. By the end of each calendar year for the lite of the mine, the applicant <br />shall provide data collected during elk monitoring programs to the <br />regulatory authority. If it becomes apparent through monitoring of elk <br />movement that haul roads are interfering with migration of the elk, the <br />applicant shall use fencing approves by the regulatory authority. The <br />fencing shall be employed to minimize impacts of roads during migration <br />periods. <br />/7. If any adverse impacts to fish and wildlite are discovered during the <br />proposed monitoring programs, the applicant must, in consultation with <br />regulatory authority, take appropriate measures to mitigate the iq~pacts. <br />p~'8. faulted blocks of coal within the limits of the approved permit a11rea <br />shall not be left unmined without the express written consent of the <br />regulatory authority in consultation with the U.S. Geological Survey <br />(USGS) Area Mining Supervisory. When detailed geologic information <br />concerning these faulted areas is obtained through the mining process, <br />de tail ea information and plans shall be submitted to the regulatory <br />authority and the USGS Area Mining Supervisor. A determination will then <br />be made by the regulatory authority about the economic feasibility of <br />recovering the coal. <br />^t 9. No coal seams (Lennox, rider seams, Wadge) or coal seam splits 28 inches <br />or greater in thickness will be spoiled or left unmined without the <br />express written consent of the regulatory authority and the USGS Area <br />Mining Supervisory. The area mining Supervisor may require the mining of <br />~ coal seams or splits that are less than 28 inches in thickness. <br />0 <br />10. Auger mining shall not be allowed without the express written consent of <br />the regulatory authority and the USGS Area Mining Supervisor. <br />-14- <br />
