The Division finds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br />of this time, August 3, 1998, the operator is current in the payment of reclamation fees <br />required by 30 CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4. <br />I. Roads -Rule 4.03 <br />Effective September 30, 1997 Nielson & Associates, Inc. and Nucor Oil & Gas, Inc. <br />purchased all the property the mine is located on. Nielson is the operator for the <br />McCallum and South McCallum oil and gas units. For purposes of ingress and egress to <br />a neazby well owned by Nielson and Nucor, they constructed a permanent road in the fall <br />of 1997. This road crosses the permit area and they have requested that the road be <br />retained by letter dated July 13, 1998 (MR-11). <br />A. Haul Roads <br />Alternative criteria and specifications were not used during the design of <br />haul roads. (4.03.1(I)(e)). <br />a. Road grades were low, generally 3-6%. <br />b. These roads did not cross any defined stream channels or <br />drainages. <br />c. The watersheds above the road was small (50 ac. max.). <br />The Division reviewed the relevant Sections of the permit application (Section D, pages <br />6-9) for compliance. All haul roads have been reclaimed; the following haul road <br />description applies to the original approval of the mine permit. <br />The haul road at the mine was in two Sections.
