The Flatiron Companies do not control and have not controlled mining operations with a <br />demonstrated pattern of willful violations of the Act of such nature, duration, and with <br />such resulting irrepazable damage to the environment as to indicate an intent not to <br />comply with the provisions of the Act. (2.07.6(2)(h)). <br />9. The Division finds that surface coal mining and reclamation operations to be performed <br />under this permit will be consistent with other such operations anticipated to be <br />performed in areas adjacent to the permit area. (2.07.6(2)(1)). <br />10. The Bourg mine is currently bonded for $214,400.00. The reclamation bond is a <br />corporate surety issued by the St. Paul Property and Liability Insurance Company. It is <br />issued to the Flatiron Companies. The last rider was issued in February 1991. <br />(2.07.6(2)(j)). <br />A Phase I bond release was approved December, 1989. The current bond amount is 40% <br />of the original bond amount. It reflects the minimum bond that the Bourg Strip Mine can <br />have following a phase I bond release. <br />A Phase II and III bond release was approved in April, 1996 for the Northgate Loadout. <br />The bond liability was reduced by $3,839.00. The Flatiron Companies did not reduce the <br />bond amount to reflect the reduction in liability. <br />11. Based on information provided by the applicant on page 2.04.12 and Division contact <br />with the U.S.D.A. Soil Conservation Service, the Division finds that there are no prime <br />farmland soils within the permit azea. <br />12. Based on information provided in the application the Division has determined that an <br />alluvial valley floor exits within the permit or adjacent area. The Division has reviewed <br />the alluvial valley floor study prepared by Leonard Rice Consulting Water Engineers and <br />included in Appendix I of the application. <br />Two areas were identified within or adjacent to the mine that met the geomorphic criteria <br />of alluvial valley floors. Deposits of unconsolidated alluvial materials were identified <br />along Mann Draw and at the confluence of Mann Draw and the Canadian River. <br />However, only the alluvium of the Canadian River located ].7 miles below the mine site, <br />met the hydrologic criteria for an alluvial valley floor. For additional specific findings <br />concerning this alluvial valley floor please see Section B, XVII of these findings. <br />13. The Division hereby approves the post-mining land use of rangeland and wildlife habitat. <br />It was determined that rangeland and wildlife habitat meet the requirements of Rule 4.16 <br />of the permit area. (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are addressed in <br />Bourg Strip Mine. C-81-021 14 August 4, 1998 <br />
