The Flatiron Companies do not control and have not controlled mining operations with a
demonstrated pattern of willful violations of the Act of such nature, duration, and with
such resulting irrepazable damage to the environment as to indicate an intent not to
comply with the provisions of the Act. (2.07.6(2)(h)).
9. The Division finds that surface coal mining and reclamation operations to be performed
under this permit will be consistent with other such operations anticipated to be
performed in areas adjacent to the permit area. (2.07.6(2)(1)).
10. The Bourg mine is currently bonded for $214,400.00. The reclamation bond is a
corporate surety issued by the St. Paul Property and Liability Insurance Company. It is
issued to the Flatiron Companies. The last rider was issued in February 1991.
(2.07.6(2)(j)).
A Phase I bond release was approved December, 1989. The current bond amount is 40%
of the original bond amount. It reflects the minimum bond that the Bourg Strip Mine can
have following a phase I bond release.
A Phase II and III bond release was approved in April, 1996 for the Northgate Loadout.
The bond liability was reduced by $3,839.00. The Flatiron Companies did not reduce the
bond amount to reflect the reduction in liability.
11. Based on information provided by the applicant on page 2.04.12 and Division contact
with the U.S.D.A. Soil Conservation Service, the Division finds that there are no prime
farmland soils within the permit azea.
12. Based on information provided in the application the Division has determined that an
alluvial valley floor exits within the permit or adjacent area. The Division has reviewed
the alluvial valley floor study prepared by Leonard Rice Consulting Water Engineers and
included in Appendix I of the application.
Two areas were identified within or adjacent to the mine that met the geomorphic criteria
of alluvial valley floors. Deposits of unconsolidated alluvial materials were identified
along Mann Draw and at the confluence of Mann Draw and the Canadian River.
However, only the alluvium of the Canadian River located ].7 miles below the mine site,
met the hydrologic criteria for an alluvial valley floor. For additional specific findings
concerning this alluvial valley floor please see Section B, XVII of these findings.
13. The Division hereby approves the post-mining land use of rangeland and wildlife habitat.
It was determined that rangeland and wildlife habitat meet the requirements of Rule 4.16
of the permit area. (2.07.6(2)(1)).
14. Specific approvals have been granted or are proposed. These approvals are addressed in
Bourg Strip Mine. C-81-021 14 August 4, 1998
