-2- <br />Proposed Loci si on <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application fora permit to conduct coal mining submitted <br />by Bear Coal Company for the Bear No. 1, No. 2 and No. 3 mines. <br />This approval decision is based on a finding that the proposed operation <br />will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, 39-33-I01 et seq., and the regulations <br />promulgated thereunder. <br />The permit application and the stipulations will become a binding part of <br />the permit upon approval. The stipulations for the Bear mine are as <br />follows: <br />1. PRIOR TO SEDIMENT POND CONSTRUCTION, THE PERMITTEE WILL SUBMIT TO THE <br />DIVISION REVISED POND DESIGNS WHICH WILL INSURE THAT RUNOFF STORAGE CAPACITY <br />FILL NOT BE REDUCED BY GROUND WATER DRAINING INTO THE POND AT ANY <br />TIME DURING THE YEAR. FURTHERMORE, THE PLAN WILL INCLUDE A PRO- <br />POSAL FOR LINING THE POND, OR OTHERWISE PREVENTING THE CONTAMINATION <br />OF NEAR SURFACE GROUND WATER AS A RESULT OF PERCOLATION THROUC,H <br />THE ALLWIUFf. <br />2. WITHIN ONE MONTH OF PERMIT ISSUANCE,-THE PERAfITTEE WILL-SUBMIT-TO-TXE - <br />DIVISION A REVISED PLAN FOR HANDLING POSSIBLE FLOODING OF PORTIONS <br />-- OF THE PERMIT AREA. THE PLAN FALL INCLUDE AN EVALUATION OF ALTfiRNATIVF <br />FLOOD CONTROL TECHNIQUES AND POTENTIAL DOWNSTREAM EFFECTS OE ANY FLOOD <br />DSVERSIONS. EFFECTS OF TXE RIVER CHANNEL RELOCATION ON FLOODING I-N - <br />THE AREA WILL BE INCLUDED IN TXE EVALUATION. <br />3. WITHIN 1 MONTH OF PERMIT ISSUANCE, T_HE_PERMITTEE WILL SUBMIT TO THE DIVISION <br />A DETAILED PLAN FOR HANDLING AND TREATING ANY DISCHARGE OF WATER <br />FROM THE UNDERGROUND WORKINGS WHICH DOES NOT MEET THE EFFLUENT <br />LIMITATIONS OF 4.05.2. THE PLAN WILL ADDRESS THE MEASURES TO BE <br />USED TO PREVENT OR CONTROL GRAVITY DISCHARGE INCLUDING CONVEYANCE <br />TO, MAINTENANCE OF, AND DISCHARGE FROM SUMPS, SEDIMENTATION PONDS <br />OR A TREATMENT FACILITY ON THE PERMIT AREA. <br />4. THE APPLICANT WILL SUBMIT TO THE DIVISION AN ANNUAL REPORT OF <br />INFLOWS, DISCHARGES AND CONSUMPTION OF WATER WITHI;T THE MINE. <br />THIS REPORT IS TO INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION <br />AND QUANTITY OF INFLOWS; A TABLE KEYED TO THE MINE MAP WHICH SHALL <br />CONTAIN THE SOURCE (i.e., FAULT, FRACTURES, ETC.), QUANTITY, <br />DURATION AND QUALITY (i .e., pH, ELECTRO-CONDUCTIVITY AND TEMPERA- <br />TURE) OF ALL INFLOWS; A TABLE CONTAINING RECORDS OF WATER DISCHARGED <br />FROM THE MINE, CONSUMED IN THE MINE AND IMPORTED FOR USE WITHIN <br />THE MINE; A DISCUSSION OF [WATER BALANCE [WITHIN THE MINE; AND <br />FINALLY, A PROJECTION OF HYDROLOGIC IMPACTS OF MINING IN THE <br />UPCOMING YEAR. <br />
