C~ • (5) Specifications that define (a) each type of material to be used in the slope, (b) requirements for preparation of the foundation prior to and during fill placement, and (c) placement requirements, such as moisture content and degree of compaction. ii. A quality assurance plan for the installation of the slopes shall be prepared by a Colorado registered engineer and shall be submitted to Thornton for review and comment at least thirty (30) days before the start of installation. The quality assurance plan shall include the following: (1) Procedures that will be used to provide horizontal and vertical control and assure that the appropriate material is placed as required by the design; (2) Descriptions of the field and laboratory tests that will be performed and the frequency of each type of test; (3) Actions to be taken if unsatisfactory material or workmanship are discovered in the installation; (4) Qualifications of field and office personnel that will perform the quality control. iii. Thomton shall have the right to observe any portion of the slope installation. iv. Any interim written quality control observation reports and results of field and laboratory tests received by Aggregate shall be provided to Thornton upon or before the execution of this Agreement and shall continue to be provided during the installation of the slopes. Thomton may also have a representative present at any meetings between Aggregate and its consultants or contractors relating to the installation of the slopes, and Aggregate shall notifyThomton of any such meetings at least twenty-four (24) hours prior to the time of the meeting. v. A final completion report prepared by a Colorado registered engineer that demonstrates the fill was placed in accordance with the plans and specifications shall be provided to Thornton within sixty (60) Hammer Option & Purchase Agreement December 11, 2000 Page 10 of 29
