Thus it is appropriate <br />for CC&V to proceed with construction in compliance with these understandings and beliefs. <br />The only remaining part of the technical revision that CC&V should not act upon at this time <br />is the thickness of the Drain Cover Fill. <br />As I am certain you understand, in view of delays caused in 1994 and 1995 due to uncertainty <br />as to whether technical revisions were acceptable, we wish not to experience delays caused by <br />initiating an activity and then finding we must place a contractor on standby while a technical <br />construction issue is reviewed. CC&V will continue to work to resolve any remaining issues <br />the Office may have about the Drain Cover Fill. It would be extremely reassuring to CC&V, <br />in the meantime, if you were able to confirm our staled understanding so as to avoid, as much <br />as possible, unnecessary construction delays. The contractor is ready to start operations a8 soon <br />as CC&V provides clearance and the Office of Mined Land Reclamation approval is a critical <br />basis for such clearance. <br />Please confirm, if you can, our understandings with respect to the aspects of the January 9, 1996 <br />Technical Revision.
