<br />In a phone conversation with John Nelson on June 22, he said <br />they had finally found Harry Ranney, and he confirmed the first (3-g <br />structure had been built the way he had designed them. <br />This $800.00 claim is actual cost in labor and equipment to <br />remove the form works, backfill the excavation, re-excavate and <br />reset forms, with overhead. Q <br />CWL has requested compensation on this work. DGM has offered <br />$400.00, half the cost. When asked how they arrived at their . <br />figure, they said by cutting CWL's cost. <br />ITEM # 7 AMOUNT - $1800.00 <br />This is for additional work on bid Item 3A, Chens Hill Damage <br />Control with Riprap, which is referred to in Paragraph 7 above <br />relative to inspection. <br />This item was completed to a quality superior to that required-~ <br />by the contract. By the contract it should have had 110 cubic <br />yards of riprap. CWL put 50 additional cubic yards of riprap in <br />this ditch when it was originally built. CWL used this extra rock <br />because it makes placing it easier. CWL is asking for $800.00 in <br />addition to the original bid price of $1000.00 for the 2 times CWL <br />went back and added rock after the project was properly completed. <br />The State failed to promptly inspect this work as required by <br />the contract. Three large rain storms first covered the riprap, <br />then started eroding dirt and rock away at the lower end of the <br />ditch. Prompt inspection would have revealed that CWL properly <br />performed before these natural occurrences. <br />Line Item #3A, for $1000.00 appears to be part of CWL's unpaid <br />invoices for a total claim of $1800.00. <br />ITEM # 8 AMOUNT - $5000.00 <br />This claim is for additional labor and machine time required <br />by CWL because of the State's negligence by failing to stake the <br />outer limits of grading as required by the contract. CWL asked <br />constantly for staking, but never got an adequate response or any <br />staking. The amount of the time justifying the claim is due to <br />having to move dirt further and in more confined areas than would <br />have been the case if staked. <br />ITEM # 9 AMOUNT - $2100.00 <br />The concrete structure (line Item #12 D) and task 12 of special <br />conditions. requires construction of 15 structures within 2200 feet <br />- 6 - <br />
