•. <br />John Nelson asked me to build three water bars at this area. <br />I told him that this was a change, and that if he wanted water <br />bars, he would be required to pay for them. When I was off the <br />site he had an employee of mine do this work. It took 35 hours to <br />walk the dozer there and build the water bars and return. We <br />didn't remove any trees or brush or change grades in association <br />with our work in this area. <br />The demobilization clause in the Special Conditions states <br />that "additional final grading shall be accomplished, if needed to <br />reduce steep slopes." The water bars actually increased the <br />steepness of this slope. I have requested a change order for this <br />work, but it has been denied. This item is as of yet, still <br />unbilled. <br />ITEM $ 5 AMOUNT - $8670.00 <br />In change order #2 dated 5-26-94, DMG deleted from the <br />contract line item #12A- East Pit Channel with erosion mat, #12B- <br />East Pit Channel with erosion mat and riprap and #12D-3 each drop <br />structures. CWL acknowledges their right to delete these items and <br />didn't proceed further with this work. However, CWL did refuse to <br />sign this change order as this work was partially completed and CWL <br />had made substantial efforts to complete this work. <br />The General Conditions 1993 General Bid Specifications #20, <br />estimated quantities, 3rd paragraph states the contract price & <br />time for completion of work will be adjusted accordingly by mutual <br />agreement, for a deletion. They deleted $11,300.00 of work of <br />which CWL had completed $8,670.00. CWL is not demanding <br />anticipated profits, just payment for the work performed. <br />ITEM # 6 AMOUNT - $800.00 <br />The drawings included with the Special Conditions show a plan <br />view of the concrete drop structures CWL built. It is unclear to <br />this day which way they should face. The General Conditions 1993, <br />General Bid Specification #11, "Plans and Working Drawings", <br />states: "The drawings if any, included with this specification are <br />complete and adequate for construction." <br />CWL's subcontractors excavated for the first structure on <br />Saturday, June il. They formed and poured concrete at 10:00 a.m, <br />Monday June 13th. They also excavated for 2 more structures that <br />day, and set the forms for the second structure. John Nelson was <br />on site at 12:00 p.m., but didn't inform anyone that he thought <br />they.were backwards until 3:00 p.m. The concrete crew left and CWL <br />almost couldn't get them back. <br />- 5 - <br />
