This is a change of conditions and required extra <br />work and extra time, as they are all bunched up in a small valley, <br />making scheduling and construction difficult and time-consuming. <br />The amount of the claim is based on CWL's estimate of lost <br />efficiency. <br />ITEM # 10 AMOUNT - $3500.00 <br />To repair CWL's seed drill, as CWL was required to seed into <br />the rock. This was due to a change of conditions. The State <br />indicated that they had enough topsoil to cover the entire project. <br />They were short in all areas. The topsoil borrow areas and some <br />areas that didn't receive topsoil were rock. This rock destroyed <br />CWL's seed drill. <br />ITEM # 11 AMOUNT - $5500.00 <br />CWL quarried and stockpiled a large quantity of riprap to be <br />used in the East Pit Channel Reconstruction (Bid schedule item <br />#12 D, drop structures, task 12). Some of this is still stockpiled <br />on site. Altogether, 9 structures were deleted of 15 to be <br />completed according to the contract. Claim Item #5 above addresses <br />3 of the 9 deletions. This claim is for the work to quarry riprap <br />for deleted work (6 more structures), along with compensation for <br />the extra riprap CwL placed in the 6 structures built and the <br />rundown area at the far north end of the channel. <br />as <br />John Nelson asked CWL to use the extra riprap in the <br />structures CWL had built and place some at the North end of this <br />channel where the channel ran out of the project area. He <br />indicated at the time he would pay for this work. At other times <br />he balked when asked for compensation. CWL placed some of this <br />extra rock in the structure built. Also some was placed at the <br />North end of the channel where it runs out of the project. <br />Please see the estimated quantities clause of the General <br />Conditions. CWL demands to be paid for the portion of the deleted <br />work that CWL did prior to it being deleted, also for the extra <br />work that John Nelson requested. <br />ITEM # 12 AMOUNT - $40,000.00 <br />The first stockpile of topsoil just north of Chens Hill <br />extended six foot below all the surrounding areas. It was 200 feet <br />wide by 300 feet long. We excavated, hauled and placed this soil <br />at a cost of $3.00 per cubic yard. At the September meeting <br />between John Nelson, Dave Bucknam, Jim McArdle and myself, they <br />acknowledged that this constituted a change of conditions. At this <br />- 7 - <br />
