The Division is proposing to approve the use of a disposal area for excess spoil <br />(4.09.1(1)). <br />2. The Division has reviewed the design for the fill and proposes to approve it <br />(4 A9.1(2)). <br />3. The Division proposes to approve of the location of the disposal area (4.09.1(6)). <br />4. The Division proposes to approve the use of terraces in order to control erosion <br />and enhance stability of the pile (4.09.1(9)). <br />VIII. Coal Mine Waste Banks <br />No coal mine waste is present at this mine. Therefore, the requirements of this <br />section do not apply (4.10.](])). <br />IX. Coal Mine Waste <br />1. No coal mine waste is present at this mine. Therefore, the requirements of this <br />section do not apply (4.11.1). <br />X. Backfilline and Gradin¢ <br />1. The Division is proposing to approve the retention of box cut spoil or initial cut <br />spoil outside the pit area since the applicant has demonstrated that such material is <br />not required to achieve approximate original contour in accordance with 4.09.1. <br />See Section VII for additional information (4.14.1(2)(d)). <br />Xl. Reveeetation <br />The revegetation plan is discussed on pages 780-117-1 through 780-138 of the <br />permit document. <br />1. The Division proposes to approve the use of introduced species in the reclamation <br />seed mix. The applicant has submitted information which shows that the <br />introduced species aze desirable and necessary to achieve the approved <br />post-mining land use, and are not poisonous or noxious (4.15.2). <br />2. Methods to measure herbaceous cover and production, species diversity, are <br />discussed on page 780-137(c). Sampling of reclamation and reference areas will <br />be done concurrently. Sampling will be performed using a 10-point frame to <br />determine cover by species.
