_29_ The Sagebrush community at the Munger Canyon site did not have a corresponding representative at the McClane Canyon site, with which data could be compared. It is therefore stipulated: Stipulation No. 9 THE PERMITTEE SHALL RESAMPLE THE HUNGER CANYON BIG SAGEBRUSH COMMUNITY FOR PRODUCTION DURING THE 1983 CROWING SEASON. THE SAMPLING SHALL BE OF RN INTENSITY TO MEET SAMPLE ADEQUACY REQUIREMENTS OF THE DIVISION. THE RESULTS OF THE SAMPLING SHALL BE SUBMITTED TO THE REGULATORY AUTHORITY NO LATER THAN 30 DAYS AFTER THE COMPLETION OF SAMPLING RND BEFORE SEPTEMBER 30, 1983. It was determined by the Division that the production data for the reference areas for the Munger Canyon vegetative communities did not meet sample adequacy requirements. Due to the small area of disturbance at the Munger Canyon site, the Division has determined that pre-mine cover and productivity data may be applied as revegetation success criteria provided the permittee can demonstrate that pre-mine sampling provides data which is representative of what may be expected from the vegetative communities present. It is therefore stipulated: Stipulation No. 10 THE PERMITTEE SHALL SUBMIT TO THE REGULATORY AUTHORITY A DEMONSTRATION OF THE REPRESENTATIVENESS OF THE VEGETATIVE SAMPLING FOR THE VEGETATIVE COMMUNITIES AT THE HUNGER CANYON SITE. TN IS DEMONSTRATION SHALL ADDRESS RAINFALL AMOUNT AND SEASONALITY FOR THE YEAR OF VEGETATION SAMPLING AND THE TWO PREVIOUS YEARS AND COMPARE THIS INFORMATION TO MEAN PRE- CIPITATION AMOUNTS AND SEASONALITY FOR THE LOCATION. THIS DEMONSTRATION SHALL BE SUBMITTED 60 DAYS AFTER PERMIT ISSUANCE. Salt Creek Mining Company has not demonstrated that adequate woody plant density sampling has taken place at the Munger Canyon site. It is therefore stipulated: Stipulation No. 11 THE PERMITTEE SHALL SUPPLY THE REGULATORY AUTHORITY WITH WOODY PLANT DENSITY DATA FOR ALL SAMPLED COMMUNITIES TO INCLUDE, BUT NOT BE LIMITED TO, SAMPLE SIZE, SAMPLE AtEAN, SAMPLE VARIANCE, AND LEVEL OF CONFIDENCE ACHIEVED. IF SAMPLING ADEQUACY IS NOT MET, THE PERMITTEE WILL BE REQUIRED TO RESAMPLE AS NECESSARY DURING THE 1982 GROWING SEASON. THIS INFORMATION SHALL BE PROVIDED TO THE DIVISION WITHIN 30 DAYS OF PERMIT ISSUANCE. Revegetation Plan (2.05.4(2)(e)) and Revegetation Success (4.15) The Division has reviewed the Munger Canyon revegetation plan and proposed success criteria (Section 3-5, Volume I). The applicant has proposed stocking woody plant species in each of the affected communities. The stocking levels proposed vary from the pre-mining densities. No justification has been provided for the lowered densities. It is therefore stipulated:
