To soi 1 <br />No specific approvals have been granted. <br /> <br />Sealing of Drilled Holes and Underground Openings <br />The Division will require that each hole, well or other underground <br />opening be capped, sealed, backfilled, or otherwise properly <br />managed (4.07.3). In order to address the possible discharge of <br />water through the Helen and Animas portals, the following <br />stipulation is required: <br />Stipulation No. 9 <br />WITHIN 90 DAYS OF PERMIT RENEWAL APPROVAL, THE PERMITTEE WILL <br />SUBMIT TO THE DIVISION AN EVALUATION BASED ON EXISTING AVAILABLE <br />INFORMATION OF THE POTENTIAL FOR DISCHARGE FROM THE HELEN AND <br />ANIMAS PORTALS FOLLOWING RECLAMATION. IF THIS EVALUATION CONCLUDES <br />THAT A REASONABLE POTENTIAL FOR DISCHARGE EXISTS, THE PERMITTEE <br />WILL, WITHIN 60 DAYS OF COMPLETION OF EVALUATION, PROVIDE AND <br />COMMIT TO A MONITORING PLAN AND REMEDIATION PLANS TO PREVENT OR <br />CONTROL DISCHARGE IF SUCH NEED IS INDICATED BY MONITORING RESULTS. <br />ADDITIONALLY, IF ONGOING DISCHARGE IS PROPOSED, THE PERMITTEE WILL <br />OBTAIN EITHER APPROVAL OR WAIVER FROM THE COLORADO DEPARTMENT OF <br />HEALTH REGARDING THE NPDES/CPDS PERMIT IF THE SEDIMENTATION POND IS <br />REMOVED AFTER PHASE TWO BOND RELEASE. <br />VI. Use of Explosives <br />No specific approvals have been granted. <br />VII. Disposal of Excess Spoil <br />No specific approvals have been granted. <br />VIII. Coal Mine Waste Banks <br />The disposal area will be inspected on a regular basis by a <br />qualified professional specialist under the direction of the <br />professional engineer, experienced in construction of similar earth <br />and waste structures. Inspection by this person has been approved <br />by the Division as appropriate (4.10.2(1)). In order to insure <br />compliance with rule 4.10.4 concerning compaction, the following <br />stipulation is required: <br />Stipulation 10 <br />WITHIN 90 DAYS OF PERMIT RENEWAL APPROVAL, THE PERMITTEE WILL <br />SUBMIT FOR APPROVAL A DETAILED PROPOSED COMPACTION TESTING PROGRAM <br />TO BE PERFORMED ON THE COAL REFUSE WASTE PILE. THIS PROPOSED <br />PROGRAM WILL ADDRESS COMPLIANCE WITH APPLICABLE COMPACTION <br />REQUIREMENTS OF RULE 4.10.4(3)(6). IF THE TESTING PROGRAM <br />INDICATES THAT THE COAL REFUSE WASTE PILE DOES NOT MEET THE <br />-13- <br />
