<br />APPLICABLE COMPACTION REQUIRE- MENTS OF RULE 4.10.4, THE PERMITTEE <br />WILL SUBMIT AND COMMIT TO IMPLEMENTATION OF PLANS FOR A STABILITY <br />EVALUATION TO ASSESS COMPLIANCE WITH THE OVERRIDING STABILITY <br />DESIGN CRITERIA OF RULE 4.10.4(2). <br />IX. Coal Mine Waste <br />1. No specific approvals have been granted. <br />X. Backfiliing and Grading <br />In order to insure compliance with Rule 4.14.2 the following <br />stipulation is required: <br />Stipulation No. 11 <br />WITHIN 180 DAYS OF PERMIT RENEWAL APPROVAL, THE PERMITTEE WILL <br />SUBMIT FOR APPROVAL PLANS FOR HIGHWALL ELIMINATION AS ALLOWED BY <br />THEN CURRENT REGULATORY REQUIREMENTS FOR ALL REGULATED HIGHWALLS <br />WITHIN THE PERMIT AREA. THESE PLANS SHOULD FACILITATE REVIEW AND <br />DEVELOPMENT OF SITE-SPECIFIC RECLAMATION MEASURES FOR INDIVIDUAL <br />HIGHWALL SEGMENTS TO BEST MEET OVERALL RECLAMATION OBJECTIVES. <br />2. The Division approves the method and design specifications for <br />covering of acid-and toxic-forming materials in order to prevent <br />leaching into surface and ground water and to insure backfill <br />stability (4.14.3(2)). <br />XI. Revegetation <br />The Division proposes to approve the use of introduced species in <br />the reclamation seed mix. The applicant has submitted information <br />which shows that the introduced species are desirable and necessary <br />to achieve the approved post-mining land use, and are not poisonous <br />or noxious (4.15.2). <br />2. Methods to measure herbaceous cover and production, species <br />diversity, and woody plant density are discussed in the permit <br />application volume 2, on page 522. <br />XII. Post-mining Land Use <br />1. The following stipulation is needed in order to complete this <br />section: <br />Stipulation No. 12 <br />WITHIN 30 DAYS OF PERMIT RENEWAL APPROVAL, THE PERMITTEE WILL <br />SUBMIT TO THE DIVISION COPIES OF WRITTEN COMMENTS CONCERNING THE <br />PROPOSED POST-MINING LAND USE FROM THE SURFACE OWNERS OF THE <br />PERMITTED AREA. WRITTEN COMMENTS FROM ANY STATE OR LOCAL <br />GOVERNMENT AGENCIES HAVING LAND-USE JURISDICTION WILL ALSO BE <br />PROVIDED PER RULE 2.05.5(1)(b). <br />-14- <br />
