Adequate data were supplied by the operator <br />in regard to one of the three AVFs, the Picketwire Valley (mainstream of <br />the Purgatoire River) for the Division to make the findings required by <br />Rules 2.06.8 and 4.24 which are: <br />1. The proposed mining operations would not interrupt, discontinue, or <br />preclude farming on the Picketwire Valley alluvial valley floor, <br />2. The proposed mining operations would not cause material damage to <br />the quantity and quality of surface and ground water that supply <br />the Picketwire Valley alluvial valley floor. This finding was <br />conditioned that the refuse pile not be expanded until the effects <br />of it on the AVF be assessed. This condition was satisfied as part <br />of the approval of technical revision (TR-04) allowing expansion of <br />the refuse pile. Data was supplied to demonstrate that drainage <br />from the pile would not cause material damage to the Picketwire <br />Valley AVF. <br />3. The proposed mining operations would preserve or restore the <br />essential hydrologic functions of the Picketwire Valley alluvial <br />valley floor. <br />Two other drainages in the permit and adjacent area, Apache and <br />Santistevan Canyons, were determined by the data available at the time to <br />contain alluvial valley floors, In the absence of adequate data being <br />supplied by the operator for the Division to make the required findings <br />of compliance with Rules 2.06.8 and 4.24, Stipulation No. 14 was imposed <br />on the approval of the original permit. Apache Canyon was subsequently <br />proven not to possess the necessary qualifications for an AVF. Such data <br />was never provided for Santistevan Canyon until the submittal of the <br />permit revision. Upon the review of the study provided by WFC the <br />Division has determined the necessary conditions do not exist in <br />Santistevan Canyon to qualify it as an AYF. However, due to the lack of <br />data provided for Wet Canyon in compliance with Rules 2.06.8 and 4.24. <br />_P7_ <br />
