<br />To ensure that the effects of the surface and underground mining <br />activities on the quantity and quality of surface and ground water in the <br />permit and adjacent areas are adequately monitored, Stipulation No. 10 <br />was made to the approval of the original permit. Stipulation No. 10 <br />contained specific requirements as regards the type and frequency of <br />surface and ground water monitoring to be conducted for the Golden Eagle <br />Mine. These requirements were changed as a result of the approval of <br />Technical Revision 02. The current monitoring program is found on pages <br />2.05.34-37 and in Tables 1 and 2 of Exhibit 10 of the permit <br />application. Location of the monitoring stations appear on Map 7. <br />Asa result of the approval of Pond no. 5 for treatment of mine water <br />prior to discharge, well PAW-7 was added to the program to monitor the <br />effects of this pond on the Purgatoire Alluvial Valley Floor. This well <br />will have the same monitoring requirements as wells PAW 5 and PAW 6. <br />Stipulation No. 10 was satisfied during the first permit term, The <br />surface and ground water monitoring program described on pages 2.05.34-37 <br />of the renewal application is accepted as adequate for the permit term. <br />Stipulation No. 11 was made to the approval of the original permit in <br />order to define the impacts of underground coal mining on both surface <br />and ground water. Annual inflow studies were required for the mine, and <br />the results were to be submitted by the first of August of the same year <br />in the Annual Hydrology Report, Stipulation No. 11 was satisfied during <br />the first permit term. The annual inflow study described on <br />Pages 2.05.39 and 40 of the permit application is accepted as adequate <br />for the permit term, <br />Information has not been supplied by the operator to completely describe <br />the stream/alluvial systems of the permit area, specifically that of <br />Wet Canyon. Wet Canyon could be affected by subsidence attending <br />underlying secondary or retreat mining during the permit renewal term. <br />In order to assess potential impacts of such mining and to verify that <br />assessment, the applicant must adequately characterize and monitor all <br />streams in the permit and adjacent areas. In order to comply with <br />Rule 2.04.7(2), 2.05.6(3)(b)(iii), 2.05.6(3)(b)(iv) and 4.05.13.(2), <br />as regards Wet Canyon, Stipulation No. 52 is added. <br />Stipulation No. 52 <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER WET CANYON, THE PERMITTEE MUST <br />COLLECT DATA ON THE QUANTITY OF WATER FLOWING IN THE DRAINAGE. <br />MONITORING MUST BE SUFFICIENT TO DIFFERENTIATE SEASONAL FLOW VARIATIONS. <br />THE PERMITTEE MUST MONITOR THE QUALITY OF WATER FLOWING IN WET CANYON <br />QUARTERLY. <br />THE PERMITTEE SHALL PROVIDE AN AMENDMENT OF THE PROBABLE HYDROLOGIC <br />CONSEQUENCES OF SECONDARY OR RETREAT MINING ON THE QUANTITY AND QUALITY <br />OF SURFACE WATER IN WET CANYON. <br />ALL MONITORING MUST CONTINUE UNTIL DISCONTINUATION IS APPROVED BY THE <br />DIVISION IN WRITING. <br />-26- <br />
