<br />Stipulation No. 53 <br />PRIOR 70 SECONDARY OR RETREAT MINING UNDER WET CANYON, THE PERMITTEE MUST <br />SUBMIT TO THE DIVISION SUFFICIENT EVIDENCE FOR THE DIVISION TO MAKE <br />FINDINGS THAT SECONDARY OR RETREAT MINING UNDER THIS CANYON WILL: <br />NOT INTERRUPT, DISCONTINUE, OR PRECLUDE FARMING ON THE ALLUVIAL <br />VALLEY FLOOR; <br />NOT CAUSE MATERIAL DAMAGE TO THE QUANTITY OF GROUND WATER THAT <br />SUPPLIED THE ALLUVIAL VALLEY FLOOR; <br />PRESERVE THE ESSENTIAL HYDROLOGY FUNCTIONS OF THE ALLUVIAL VALLEY <br />FLOOR. <br />Due to the increased mine water encountered in the Second Right workings <br />in early 1988 the Pond nos. 002, 002A and 0026 were unable to properly <br />treat the mine water discharge which eventually resulted in a <br />Cessation Order (C-88-017) being issued. One of the abatement steps was <br />the construction of a new mine water discharge treatment pond. In order <br />to facilitate and treat the amount of water being discharged, a <br />relatively large level surface area was needed to construct the pond. <br />Due to the topography of the Golden Eagle Mine, the only available place <br />to construct the pond was on the upper terrace of the AVF near Pond <br />no. 003. <br />The justification for building the pond on the AVF was supported by <br />Rule 2.06.8 (5)(a)(i)(A)(I)and II which states that the area of the AVF <br />land affected provided negligible support for the production of the farm <br />and the proposed activity would not materially damage the quantity or <br />quality of water in the AVF. <br />Pond no. 005 was constructed as approved in TR-06 and was put in <br />operation on May 16, 1988. However due to same problems that could not <br />be resolved to the satisfaction of the Division the pond suspended <br />operation in September 1988. All mine water is currently diverted to <br />Pond nos. 002, 002A and 0028. At present no problem is anticipated and <br />these series of ponds seem to handle the flow without exceeding effluent <br />limits. <br />IX. Water Riohts and <br />1es 2.04.7(3), 2.05.6 (3 )(a)(ii <br />Information on water rights is contained in Section 2.05.38 of the <br />revision application. Information concerning water rights was submitted <br />to and reviewed by the State Engineers Office. Based on their review and <br />memos and correspondence contained in both Water Resource Division files <br />and Mined Land Reclamation Division files, the Division has determined <br />that the proposed operation is in compliance with the requirements of <br />this section. <br />_p g_ <br />
