Jim Pendleton of the Division. <br />Stipulation No. 11 <br />Several monitoririg points v+ill be located at the Bear No. 3 portal <br />face-up area explained in the report from Rocky I.lountain <br />Geotechnical. Bear Coal Company will periodically survey these <br />points and submit the results to the Division. <br />Stipulation No. 12 <br />I~iiscellaneous solid waste generated at the Bear No. 3 operation <br />' will be collected at various points during the construction and <br />mining activities. This waste will then be hauled to a landfill <br />located between Hotchkiss and Paonia, Colorado for disposal. The <br />' Bear Coal Company currently has a t:corking agreement with the <br />landfill for disposal of all non-coal waste from the mining <br />operation. All employees will be instructed to place trash, <br />' garbage, used paper, oily raps, etc. into appropriate containers <br />for disposal in the Delta County landfill. A conscious attempt by <br />all mine employees will be made so that all non-coal waste are <br />disposed of properly. <br />Stipulation No. 13 <br /> Due to current r:arket constraints, the bear Ccal Company has not <br />' finalized the exact location for which coal ~•rill be hauled from the <br /> mine. Given the current economic hardships, the Bear Coal Company <br /> ~:~ould like to have the flexibility to move coal to any potential <br />' market through any viable means. <br /> The Eear Coal Company may be moving coal to one of the other <br /> operators' loadout facilities near Somerset, to an independent <br />' loadout in Delta, Colorado, or tc the Colorado lJestmoreland loadout <br /> near Paonia. <br />' Because of the uncertainty with the market and the destination of <br /> the coal, the Bear Coal Company would like to request an extension <br /> from the one-month time frame set forth in the findings document to <br />' a six-month time frame fallowing permit issuance.
