I.1r. Dan Fla thews Page Six
' 11ay 27 , 1982
' Stipulation No. 7
As shown on page 582 of Volume II of the Final West-Central
' Colorado Coal Environmental ]mpact Statement prepared by the United
States Bureau of Land Management, a golden eagle's nest (eyrie)
with status unknown is shown to be located in Section 17.
' During a field survey on I.1ay 24, 1982 conducted by 11r. Dan Ilatl~ews
of the Division, 11r. Craig Springer of the bear Coal Company, and
F1r. Alan Czarnowsky of ACZ Inc., two golden eagles were sighted to
' the west of Somerset; however, no eagle eyrie was seen in the
cliffs or in the trees on the north-facing or south-facing slopes
of the IJorth Fork of the Gunnison River Valley; however,
' observations of the eyrie were made from the State Highway 133 west
of the Town of Somerset. From local knowledge with input from
various Federal and Colorado agencies, it is assumed that the
golden Bayles have been in this area for some time and have not
' been impacted by mining operations along the North Fork of the
Gunnison River or the Tovm of Somerset. From the initial
investigations on 14ay 24, 1982, it appears that the eyrie for the
' golden eaglos could be located along the higher cliffs of Lone Pine
Gulch, or- ridden from view in the north-facing cliffs along the
North Fork of the Gunnison River.
' %
t•tr. Dan 1lothews of tl~e Colorado I
~ined Land Reclamation Division
will contact representatives from the U.S. Fish and LJildlife
Service, the Colorado Division of Flildlife, or other appropriate
' governmental agencies to determine the exact location of an eyrie
and to verify that mining will not impact the eagles or their
' eyrie.
Stipulation IJo. 8
' The Fear Coal Company will retain a professional engineer to
donn:~ent the proctor density to be used in the backfilling of the
portals at the Bear IJo. 1 and No. 2 operations.
' Sti
l
ti
iJ
9
mu
a
on
o.
Follov, ing backfilling wcrk on the Bear C;o. 2 portal area, Bear Coal
' Company will install two monitoring points on the backfill at the
bear IJo. 2 portal area. These points will be monitored as required
by the Division, and the results being submitted to the Division.
'
Stipulation IJo. 10
Tlie construction details for the portal face-up area at the Bear
i~o. 3 operation will be submitted shortly under separate cover.
•,

~i ~c ING. ~)11'
