<br />XX. Mine Facilities, Coal Handling Structures, Su <br />Rules 2.05.3(3), 2.05.3(7) and 4.04 <br />port Facilities - <br />The Rimrock Coal Company has provided information on the construction, use and <br />removal of the mine office warehouse screen, crusher, stackers and conveyors <br />in Sections 2.05.3(3) and 2.05.3(7). <br />The proposed operation is in compliance with the requirements of this section. <br />XXI. Roads - Rules 2:05:3(3)(e)(i) and 4.03 <br />The applicant has provided information on drainage control for the road which <br />will be used as a haul road in Sections 2.05.3(1), 2.05.3(2) and (3 ). The <br />operator has supplied the Division with a certified design for the haul road <br />and all the requirements of 4.03.1 have been complied with. When the mining <br />operation is completed the haul road, which is a pre-existing road, will be <br />upgraded but will not be reclaimed per the landowner's request. This plan has <br />been approved by the Division. <br />The proposed operation is in compliance with the requirements of this section. <br />XXII. Bonding - Rules 2:05:4(2)(b) and 3 <br />Rimrock Coal Company has agreed to post a performance bond in the amount of <br />$53,000.00. The Division has determined this amount will be sufficient to <br />cover the costs of reclamation. Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), <br />an acceptable performance bond in this amount will be filed with the Division, <br />payable to the State of Colorado, before a permit will be issued. <br />The proposed operation is in compliance with the requirements of this section. <br />XXIII. Subsidence - Rules 2:05.6(6) and 4.20 <br />Information regarding subsidence for the Rimrock Mine operation is provided in <br />Section 2.05.6(6) and 4.20 of the permit application. The application has <br />provided sufficient data which will help to prevent material damage due to <br />subsidence of the previously undermined areas which are not directly related <br />to the stripping operation. The operator proposed to excavate areas <br />containing existing underground workings of subsidence adjacent to the <br />proposed strip pit. The Division is concerned that a possibility exists that <br />working so close to previously undermined areas would cause subsidence. <br />Therefore, the Division requires the following stipulation: <br />Stipulation 02: <br />THE OPERATOR WILL BE RESPONSIBLE FOR REPAIR OF ANY SUBSIDENCE WHICH MIGHT <br />OCCUR IN EXISTING UNDERGROUND WORKINGS WITHIN 250 FEET OF THE STRIP PIT <br />BOUNDARY. <br />The operation is in compliance with the requirements of this section. <br />- 18 - <br />
