Special Categories of Mining - Rules 2.06, 4,22, 4,23, 4.26, 4.27, <br />and <br />The requirements of this section do not apply to this operation, since none of <br />the special categories of mining will be conducted. <br />XXV, Miscellaneous Compliance --Rules 2:05.6(5), 4.02, 4.12, 4.19, 4.21, <br />4.'28 and 4.30 <br />No problems were identified with respect to the requirements of these the <br />requirements of these sections during the review. Based on the information <br />provided in Volume I of the permit application, the operation is in compliance <br />with a17 of the requirements of the above sections. <br />XXVI. Operations on Lanus Subject to Limitations or Prohibitions - <br />Rules 2.03.7 and 2.10 <br />The applicant is in compliance with the requirements of this section for the <br />following reasons: <br />1. The permit area of the operation is not within <br />a) an area designated unsuitable for mining; <br />b) an area under study for designation as unsuitable for surface coal <br />mining; <br />c) on any land subject to prohibitions or limitations; <br />d) 300 feet of an occupied dwelling. <br />The proposed operation is in compliance with the requirements of this section, <br />XXVII. Demonstration that Surface Coal Mining and Reclamation Operations <br />can be Feasibly Accomolis ed -Rule 2:07.6(2) b) <br />The Oivision finds pursuant to Rule 2.07.6(2)(8) based on information in the <br />application and from all available sources, that surface coal mining and <br />reclamation operations can be feasibly accomplished under the mining and <br />reclamation plan contained in the application. <br />The proposed operation is in compliance with the requirements of this section, <br />XXVI. Compatibility with Anticipated Adjacent Operations = Rule 2.07:6(2)(t) <br />Pursuant to Rule 2.07.6(2)(1), the Division finds that the Rimrock Coal <br />Company operation proposed at the Rimrock Mine will not be inconsistent with <br />any other such operations anticipated to be performed in areas adjacent to the <br />permit area. At this time, the only such operation to be considered is the <br />Raton Creek (Energy Fuels) underground mine which is located southwest of the <br />Rimrock Mine. The Raton Creek Mine operation is discussed in Section VIII of <br />this document. <br />The proposed operation is in compliance with the requirements of this section, <br />- 79 - <br />
