<br />Stipulations Attached to the 1986 FindinQS and Permit <br /> <br />The first five stipulations described in the "Stipulations 1985 Findings <br />and Permit" were listed in the 1986 Findings and Permit. Their status is <br />the same as those first five 1985 stipulations. <br />Nine additional stipulations are attached to the current Permit Document <br />No. C-81-038 dated July 21, 1988. These stipulations and their status are <br />listed below. <br />Note: The stipulations in the 1988 document are numbered consecutively, <br />beginning with the next number after the last stipulation in the 1981 permit <br />document. All future stipulations will be numbered consecutively continuing <br />on from the last stipulation number listed in this report in order to <br />alleviate the confusion previously caused by duplicated stipulation numbers. <br />Stipulation No. 26 <br />One year after the completion of reclamation activities at the loadout, <br />the operator shall compare the soil characteristics of the reclaimed area <br />with the adjacent undisturbed orchard areas to verify that the hydrologic <br />function of flood irrigability has been restored. Such comparison should <br />be in the form of infiltration, permeability and texture studies. <br />Ongoing. <br />Stipulation No. 27 <br />CWI shall submit right of entry information to MLRD for all <br />surface-affected lands within the permit area prior to extracting coal <br />beneath these lands or otherwise affecting them. <br />Ongoing. <br />Stipulation No. 28 <br />CWI shall complete the on-the-ground field verifications of surface water <br />resources on those lands for which right of entry has not been obtained. <br />The results of the survey shall be approved by the Division prior to CWI <br />undermining or otherwise affecting these lands. <br />Ongoing. <br />-18- <br />
