<br /> <br />Six stipulations were attached to the June 20, 1985 Permit No. C-038-83. <br />These stipulations and their status are listed below. <br />Stipulation No. 1 <br />CWI shall submit right of entry information to MLRD for all <br />surface-affected lands within the permit area prior to extracting coal <br />beneath these lands or otherwise affecting them. <br />Resolved: This stipulation is currently listed in the 1988 Permit Renewal <br />Stipulations. It was mislabeled as a second Stipulation No. 26 in the <br />1988 document. It should be recorded as Stipulation No. 27 in the 1988 <br />document. <br />Stipulation No. 2 <br />CWI shall complete the on-the-ground field verifications of surface water <br />resources on those lands for which right of entry has not been obtained. <br />The results of the survey shall be approved by the Division prior to CWI <br />undermining or otherwise affecting these lands. <br />Resolved: This stipulation is currently found as Stipulation No. 28 in <br />the 1988 document. <br />Stipulation No. 3 <br />One year after the completion of reclamation activities at the loadout, <br />the operator shall compare the soil characteristics of the reclaimed area <br />with the adjacent undisturbed orchard areas to verify that the hydrologic <br />function of flood irrigability has been restored. Such comparison should <br />be in the form of infiltration, permeability and texture studies. <br />Resolved: This stipulation appeared as Stipulation No. 1 in the 1983 <br />document and is currently found as Stipulation No. 26 in the 1988 document. <br />Stipulation No. 4 <br />The operator shall continue to submit to the Division an annual report of <br />inflows, discharges, and consumption of water within the mine. This <br />report is to include a mine workings map showing the location and quantity <br />of inflows; a table keyed to the mine map which shall contain the source <br />(i.e. fault, fractures, etc.), quantity, duration and quality (i.e. pH, <br />electro-conductivity and temperature) of all measurable inflows; a table <br />containing records of water imported for use within the mine; a discussion <br />of the water balance within the mine; and finally, a projection of <br />hydrologic impacts of mining in the upcoming year. The mine inflow study <br />shall be conducted during the month of June. If the occurrence of inflows <br />becomes significantly greater than the anticipated rates, the Division may <br />require that an additional inflow study be conducted at another time <br />during the year. <br />Resolved: This stipulation appeared as Stipulation No. 21 in the 1981 <br />document, No. 2 in the 1983 document and is currently found as <br />Stipulation No. 29 in the 1988 document. <br />-16- <br />
