<br />Stipulation No. 5 <br /> <br />Colorado Westmoreland, Inc. must submit to the Division and have approved <br />a complete topsoil handling plan for the proposed waste disposal area <br />prior to any disturbance to the area. <br />Resolved: See resolution description for Stipulation 17 of the 1981 <br />Findings Document. <br />Stipulation No. 6 <br />Colorado Westmoreland, Inc. is directed to complete, as part of a <br />technical revision, Phase III of the stability analysis and redesign of <br />the final reclaimed configuration of the surface facility area of the <br />Orchard Valley Mine, as described in the letter of proposal from <br />Geohydro Consultants, Inc., included within Volume 10 of the original <br />approved permit application. The scope of Phase III shall include the <br />utilization of the findings and recommendations of Phase II to complete <br />specific engineering redesign and amendment of the final reclaimed <br />configuration of the surface facility area of the Orchard Valley Mine. <br />This project shall proceed in a timely fashion to completion by October <br />15, 1983. The Division shall be kept informed by quarterly letter of the <br />progress of this task, by the operator. Upon completion of Phase III, the <br />reclamation plan shall be appropriately amended. <br />Resolved: See resolution description for Stipulation No. 23 of the 1981 <br />Findings Document. <br />Stipulation No. 7 <br />Colorado Westmoreland, Inc. is directed to finalize the design (including <br />drainage designs) of the proposed long-term coal processing waste disposal <br />structure at the Orchard Valley Mine. This design is to be submitted as a <br />technical revision prior to July 31, 1983. Prior to appropriate revision <br />of the mine plan, the operator shall continue placement of coal processing <br />waste at the existing waste pile location. The total amount of coal <br />processing waste placed in the existing structure shall not exceed <br />25,000 cubic yards. Furthermore, in addition to the inspection and <br />reporting requirements of Rule 4.10.2, Colorado Westmoreland, Inc. shall <br />submit records or calculations to verify the total accumulated quantity of <br />coal processing waste disposed of at the existing site as a portion of its <br />quarterly inspection report to be submitted to the Division. <br />Resolved: See resolution description for Stipulation No. 16 of the 1981 <br />Findings Document. <br />Stipulation No. 8 <br />Within 90 days after the completion of Phase III of the stability analysis <br />and redesign of the final reclaimed configuration of the surface facility <br />area of the Orchard Valley Mine, the applicant must submit to the Division <br />a revised backfilling and grading cost estimated for the surface facility <br />area. If this revised cost figure is greater than the present estimate, <br />the amount of the reclamation bond will be increased accordingly. <br />Resolved: See resolution description for Stipulation No. 24 of the 1981 <br />Findings Document. <br />-15- <br />
