The stoc]q~ile location will be the area where the <br />scales aze presently setting. <br />-Revegetate the Mid-Continent pit according to the <br />rehabilitation plan agreed to by the BLM. <br />-Close the existing roads within the mine area by pulling <br />Lill slope material up agairi5t the cut slopes as called for <br />in the reclamation plan to reduce the overall grade and <br />promote rehab success. <br />-The BLM will deal exclusively with one company: <br />Mid Continent or Pitkia Iron, for all aspects of <br />operations. That company will hold the permit and the <br />bond and will be responsible for reclamation. <br />-A bond amount of $20,000 must be secured prior to permit <br />issuance. <br />-The hazardous materials (total) payment of $1,060 which <br />must be paid in advance_ <br />-The permit would be for 30,000 tons of non-metallurgical <br />grade limestone fines, 522,500 over a five year perir.d <br />($2,250 must be paid in advance). The remainder mus: be <br />paid in accordance with 43 CFR 3610.1-3. <br />-Material must be weighed as removed from the site. Weight <br />tickets must be submitted to BLM on a weekly basis. <br />A notice of operations must be submitted to BLM in advance. <br />-BLM approval of a Mining Plan must be secured prior to <br />operations, as outlined i..n the Dec 13, 1996 letter. <br />-BLM approval of all agreements with Garfield County must be <br />secured prior to permit issuance. <br />-A seasonal closure of the Transfer Trail Road from 12 i1= <br />4/30 or as modified depending on the amount of snowfcll to <br />ensure snowmobile access to the Flattops Area. <br />GerPieZd Co>aDty agrees to do the foZZaoring: <br />-Continue to control the weed population on the Marblehead <br />Pit under the Pesticide Use Permit approved by the BT,M. <br />This requirement will be for the duration of the time over <br />which they will be removing the fines pile. It will not <br />include the first year (1997), which Mid-Continent will <br />assume. <br />-Construct a haul road to the fines pile using existing <br />roads to the extent possible. Any road construction in an <br />undisturbed nr~a will need to be approved in advance of <br />construction_ <br />
