U2 <br />COOPERATIVE AGREEMENT <br />For the Management of the Marblehead and Mid-Continent Mines <br />This agreeme.~lt between Mid-Continent Resources, Garfield County, <br />MLRB and r~1e rsl,ef. will serve to delineate each entities <br />responsibilities as to work Lo be performed at the Mid-Continent <br />and Marblehead limestone quarries. This agreement will become <br />affective on the date of the last of the parties signatures. <br />Mid-Cautineat Resources agree., to do the follawiug: <br />-Relinquish all rights and claims to the material <br />remaining at the Marblehead Mine and Mid Continent <br />mines. This includes the withdrawal of the appeal to the <br />Interior Soard of Land Appeals (IBLA). Withdrawal o.` the <br />appeal to the IBLA will be done within five (5) days of <br />the effective date of the agreement. <br />-Treat the existing weed .population on the Marblehead Mine <br />in 1997, after first obtaining a Pesticide Use Permit from <br />the BLM_ <br />-Control dust on the Transfer Trail whenever they or their <br />agents are hauling fines from the Mid-Continent pit. T}1is <br />would be by watering truck and the application o£ a <br />chemical dust suppressant. <br />-Be responsible for road maintenance of the Transfer Trail <br />to the Mid-Continent pit during periods of ongoing <br />operations. The county will do a spring/fa71 maintenance of <br />the road annually to the upper parking Iot so long a: they <br />are hauling the fines from Marblehead. <br />-Mid-Continent Resources will assign and transfer to <br />Garfield County their Permit No. M-77-420 for the <br />Marblehead Quazry. <br />-Mid-Continent will pay to the BLM the sum of Ten Thousand <br />Five Hundred Dollars ($10500.00) in order to aggregate the <br />surety required by The SLM of $20,000.00 to ensure Mid- <br />Continent completes the reclamation of the Mid-Continent <br />Quarry. <br />-Pitkin Tron agrees to pay a royalty on the pile of crushed <br />limestone, which is located separately from the fines, <br />based on its appraised value as landscaping stone. <br />-Once permitted, remove the fines (non metallurgical n..-ode) <br />pile from the Mid-Continent Pit within a five year period. <br />03/06 <br />-Remove and stockpile all large limestone boulders on the <br />mine bench Lo be used as barrier rocks along the aeeesr <br />
