Samples <br />of water from the three ponds were analyzed and <br />determined to be acceptable for consumption by livestock. <br />b. The level of water was sufficiently stable and the <br />configuration of the ponds was adequate to support the <br />intended use [Rule 4.05.9(13)(b)]. <br />The Division's inspections found over several yeazs that <br />water was present year-round in all three ponds. The Moffat <br />and West Ridge ponds discharge in response to rainfall, <br />spoil springs, and spring runoff Discharge from the Center <br />Ridge pond is generally perennial, except in extremely dry <br />yeazs. <br />c. adequate safety and access to impounded water was <br />provided to the proposed water users [Rule 4.05.9(13)(c)]. <br />d. Permanent retention of the Moffat, Center Ridge, and West <br />Ridge ponds would not result in the diminution of the <br />quality or quantity of the water available to water rights <br />holders for agricultural, industrial, recreational, or domestic <br />water uses [Rule 4.05.9(13)(d)]. <br />The ponds discharge to Trout Creek via unnamed <br />tributazies. There are no industrial, recreational, or domestic <br />uses of water between the pond outfalls and Trout Creek. <br />There aze agricultural (livestock) uses of the unnamed <br />tributaries. Continued monitoring in accordance with the <br />approved water monitoring plan and CDPS permit would <br />verify that there would be no diminution of water quality to <br />those water right holders. <br />Monitoring of Trout Creek downstream of all three pond <br />outfalls, since 1981, has supported the prediction that no <br />diminution in quality to water rights holders for domestic, <br />agricultural, industrial, or recreational use is expected. <br />P&M has obtained replacement water rights for those users <br />in the event that water quality is diminished. <br />P&M has obtained water rights to store the permanent pool <br />water in all three ponds. <br />e.
