Stipulati ors: THE DIVISION DIRECTS ARCO TO COMPLETE THE INSTALLATION OF THE <br />SUBSIDENCE MONITORING NETWORK PRIOR TO THE INITIATION OF EXTRACTION OF COAL <br />WITHIN THE PANEL DESIGNATED IN EXHIBIT 3.4.8.A FOR SUBSIDENCE MONITORING. THE <br />MONITORING NETWORK IS DESIGNED TO MONITOR THE FIFTH PANEL FROM THE ENTRANCE OF <br />THE MAIN PORTAL, WEST FROM THE MAIN, WITHIN SECTION 16. THIS MONITORING NET- <br />WORK SHALL CONSIST OF SUBSTANTIAL MONUMENTS DESIGNED TO RESIST FROST-HEAVE, <br />FIRE, AND THE ACTIONS OF CATTLE AND WILDLIFE. ARCO SHALL SUBMIT A MONUMENT <br />DESIGN TO TXE DIVISION FOR APPROVAL. Stipulation: TXE DIVISION DIRECTS ARCO TO SUBMIT REPORTS OF ITS SUBSIDENCE <br />MONITORING PROGRAM ON R SEMI-ANNUAL BASIS, COMMENCING ONE MONTH AFTER THE <br />INSTALLATION AND INITIAL SURVEYING OF THE SUBSIDENCE MONUMENTS. FURTHER, DUE <br />TO THE COMPLEXITY OF THE PERMIT AREA GEOLOGY, PRESENCE OF LANDSLIDES RND STEEP <br />SLOPES, AND SENSITIVE HYDROLOGIC ELEMENTS, ARCO IS DIRECTED TO SUBMIT A PROPOSED <br />SUBSIDENCE MONITORING REPORT FORMAT TO THE DIVISION FOR APPROVAL. THIS <br />REPORT FORMAT SHOULD RECOGNIZE THE IMPORTANCE OF CONTINUAL UPDATE OF SUBSIDENCE <br />DATA INTERPRETATION, MONITORING OF GROUND WATER LEVELS AND SPRING FLOWS, <br />MONITORING OF MINE INFLOW, AND SUBSURFACE GROUND CONDITIONS WHICH COULD BE <br />CORRELATED TO SUBSIDENCE PREDICTION. THIS REPORT FORMAT SHALL BE APPROVED <br />BY THE DIVISION PRIOR TO THE COMMENCEMENT OF EXTRACTION OF COAL WITHIN THE <br />PANEL DESIGNED IN EXHIBIT 3.4.8.A FOR SUBSIDENCE MONITORING. <br />MLRD Findings Document: Stipulation No. 42, p. 47 <br />OSM Findings Document: Stipulation No. 39, P. 11 <br />OSM TEA: Stipulation No. 32, p. 160 as follows: <br />32. Although the applicant intends to perform subsidence measurements <br />upon a greater frequency than stated in the rule (1 month vs. 1 quarter) <br />the applicant does not describe the method or content of its reports <br />to the regulatory authority. Due to the presence of landslides, <br />questionable hydrologic effects and the lack of local subsidence <br />history it is required that the applicant negotiate a formal report- <br />ing system with the regulatory authority. This precedure should <br />recognize the importance of continual update of data interpretation, <br />monitoring of ground water levels, and mining conditions in the panels <br />which could be correlated to subsidence prediction. <br />27. Stipulation: THE DIVISION DIRECTS RRCO TO COMPLETE A DETAILED ANALYSIS OF <br />THE POTENTIAL EFFECTS OF SLOPE STABILITY UPON THE STABILITY OF THE LANDSLIDE <br />DEPOSIT LOCATED ABOVE THE TOWN OF SOMERSET, REFERENCED ON PAGE 30 OF EXHIBIT <br />3.4.8.R OF THE REVISED PERMIT APPLICATION. ARCO SHALL INSTALL AND MONITOR AN <br />APPROPRIATE SET OF MONUMENTS ON THE LANDSLIDE DEPOSIT, IN ORDER TO OBSERVE <br />POTENTIAL DISPLACEMENT OF THE LAND FORM. THE DETAILED ANAYSIS SHALL BE <br />
