Stipulation 32 was attached to the TR-42 proposed decision, issued 10/14/03. The stipulation required submittal of a <br />complete revision application containing applicable demonstration of compliance for permanent road retention including <br />signed landowner requests for roads or road segments to be retained for the postmining land use. The demonstration is <br />[o be submitted to and approved by the Division prior to approval of Phase 1 Bond Release for any reclamation parcel <br />that includes a permanent road or road segment, The stipulation remains active. <br />Stipulation 33 was attached to the TR-42 proposed decision, issued 10/14/03. The stipulation required submittal of a <br />complete revision application containing a relevant showing statement in lieu of certification for the Coal Carrier's <br />Access Road. The stipulation was satisfied by submittal of TR-45, which was deemed complete on December I, 2003. <br />Stionlatinnc Resolved Prior in Permit Renewal Nn 'i Proposed nericinn Iccuancr <br />Stipulations 1 through /3 were placed on the Division's initial proposed approval decision for the Seneca //- <br />W permit, on August 8, 1985. Most of the original 13 stipulations were retained in the initial permit, issued <br />December 31, 1985. <br />Stipulation 1 required incorporation of comments from permit azea landowners and pertinent state and local agencies <br />regarding postmining land uses. The stipulation was resolved September 19, 1985. <br />Stipulation 2 required monitoring of specified permit area springs in accordance with a specified schedule. The <br />stipulation was resolved by an amended monitoring plan included in TR-l, approved May 13, 1987, <br />Stipulation 3 required monitoring of specified permit area wells in accordance with a specified schedule. The <br />stipulation was resolved by an amended monitoring plan included in TR-l, approved May 13, 1987. <br />Stipulation 4 required submittal of a plan for installation of spoil monitoring wells and monitoring of spoil water <br />quality. The stipulation was resolved by an amended monitoring plan included in TR-l, approved May 13, 1987. <br />Stipulation 5 required submittal of an annual hydrology report by February 28 each year, to summarize monitoring <br />results for the previous hydrologic year, and include impact and trend assessment. The stipulation was resolved by an <br />amended monitoring plan included in PR-1, approved in July 1991. <br />Stipulation 6 required submittal of a water rights protection/mitigation plan prior to any disturbance within the permit <br />boundary. The stipulation was resolved by submittal an acceptable plan within TR-4, approved October 6, 1989. <br />Stipulation 7 required submittal of vegetation baseline information for portions of the Tie Across Haul Road alignment. <br />The stipulation was satisfied by information submitted September 17, 1985, prior to initial permit issuance. <br />Stipulation 8 (parts A, B, and C) required specified modifications to [he revege[a[ion plan and revegetation monitoring <br />plan. 8A placed restrictions on use of alfalfa and pubescent wheatgrass, 86 specified that approval would be required <br />for any supplemental shrub and forb seedmix components, and SC required submittal of a monitoring plan. 8C was <br />resolved by MR-3, approved July I5, 1986. 8A and 86 were resolved by PR-l, approved in July 1991. <br />Stipulation 9 required the operator to submit a plan, prior to any blasting on site, demonstrating that blasting operations <br />within 500 feet of an existing oil well would not damage the well or ignite vented gas. The stipulation was resolved by a <br />plan included in TR-2, approved June 23, 1989. <br />Stipulation 10 required the operator to revise within thirty days of permit issuance, the plan addressing fmal <br />containment ditch reclamation. The stipulation was resolved by MR-3, approved July 15, 1986. <br />
