Disturbed Area Increase <br />Approve w/Condition <br />Stipulation No. 30 <br />5/1/03 <br />SECTION III -STATUS OF STIPULATIONS <br />+$1,603,625.00 <br />There are currently no unresolved stipulations associated with the Seneca II-W Mine; all previous stipulations have been <br />fully resolved, as described below. <br />Stipulation 24 originated with MR-42, July 29, 1997. The Stipulation specified that proof of resolution of Kentucky <br />Civil Penalty Violation and bond forfeiture associated with Permit 8980140 be submitted to DMG as soon as it becomes <br />available. The stipulation originated based on an Applicant Violator System (AVS) check, and resultant "Conditional <br />Issue" recommendation. The stipulation was carried forward when the RN-3 proposed decision was issued on June 19, <br />2001, based on AVS check conducted at that time. Stipulation compliance was documented based on AVS checks <br />conducted in association with Permit Revision No. 3, issued May I, 2003. <br />Stipulation 28 originated with RN-3 Renewal Permit. The stipulation required that backfilling and grading of the D pit <br />commence by November l5, 2001. The Division documented compliance during an inspection conducted on <br />November 14, 2001. Statements in the inspection report indicate that backfilling and grading operations had been <br />initiated that day and that a dozer was working a[ the east end of the D Pit, pushing spoil into the pit. D Pit backfilling <br />and grading was lazgely completed by the end of 2002. <br />Stipulation 29 was attached to the MR-5I approval decision, issued March 21, 2002. The revision was a field minor <br />revision decision approving minor modification of the temporary stabilization seedmix. The stipulation required <br />submittal of 3 copies of the amended seedmix by April 18, 2002. The properly updated pages were received on April <br />19,2002. <br />Stipulation 30 was attached to the PR-3 proposed decision, issued May I, 2003. The stipulation required sample based <br />demonstration of soil strength properties for foundation and construction soils associated with Pond 016A, prior to <br />initiation of pond construction. Adequate site specific soil strength documentation was submitted to the Division in a <br />letter of June 2Q, 2003. The Division notified SCC that Stipulation 30 had been satisfied, in a letter of July 3, 2003. <br />Stipulation 3l was attached [o the TR-42 proposed decision, issued 10/14/03. The stipulation required submittal of a <br />complete revision application containing an appropriately amended Exhibit 13-2A, accurately depicting the location of <br />specified light use roads by November 28, 2003. The stipulation was satisfied by submittal of TR-45, which was <br />deemed complete on December 1, 2003. <br />
