Stipulation 11 required the operator to obtain a water storage right for Pond 006, prior to pond constmction. The
<br />stipulation was resolved by TR-3, approved July 17, 1989.
<br />Stipulation 12 required the operator to submit within 60 days of permit issuance, a detailed plan for pond dewatering to
<br />a level to ensure containment of the design storm flow, with no discharge through the emergency spillway. The
<br />stipulation was resolved by TR-3, approved July 17, 1989.
<br />Stipulation 13 required submittal of a performance bond in the amount of $2,646,300.00, within 30 days of issuance of
<br />the proposed decision. The stipulation was resolved by submittal of the required bond, accepted by the Division on
<br />October 3, 1985.
<br />Stipulation 14, placed on the permit as a result of MR-8, required revised alignment and associated designs for a
<br />specified segment of Haul Road A. The stipulation was resolved by TR-5, approved December 14, 1989.
<br />Stipulation 15, placed on the permit as a result of TR-5, requtred submittal of additional reclamation bond, sufficient to
<br />cover additional reclamation tasks associated with activities proposed in TR-5. The stipulation was resolved by
<br />submittal of additional bond in association with TR-7, approved April 30, 1990.
<br />Stipulations 16, 17, and 18 were placed on the permit as a result of PR-/, approved September Q 199/
<br />Stipulation 16 required documentation of adequate water rights for storage of 16.46 ac.ft. of water in Pond 005, prior to
<br />pond construction. The stipulation was resolved by submittal of adequate documentation June 4, 1992.
<br />Stipulation 17 requ'ved submittal and approval of design plans for Sediment Pond 5, engineering stability evaluation for
<br />the North Pit expansion area, and plans for geotechnical monitoring and remediation of any facilities potentially affected
<br />by instability. The stipulation was resolved by TR-l6, approved May 21, 1992.
<br />Stipulation 18 required submittal of landowner request for retention of Haul Road "G", or appropriate reclamation plan
<br />for the road, prior to initiation of road construction. The stipulation was resolved by TR-16, approved May 21, 1992.
<br />Stipulation 19, placed on the permit as a result of TR-16, requved submittal of additional stability assessment for Haul
<br />Road "G", along with a stability monitoring plan for specified road cut azeas. The stipulation was resolved on June 4,
<br />1992, by submittal of acceptable assessment and plans.
<br />Stipulation 20 was placed on the permit as a result of Field MR-26, on October 16, 1993. The stipulation required
<br />submittal of amended Exhibit 13-2, to depict a series of earthen dikes in 006 Gulch, by November l5, 1993. The
<br />stipulation was resolved on October 28, 1993.
<br />Stipulation 21 had been placed on [he permit via revision, and requved proof of resolution of specified violations
<br />tracked by the OSM AVS system. The required documentation was provided and the stipulation was resolved on April
<br />12, 1996.
<br />Stipulation 22 was placed on the permit as a result of MR-32, on October 11, 1994. The stipulation required submittal
<br />of an amended Exhibit 12-2, to depict a coal slack pile a[ [he North Pit near Road G by November IQ 1994. The
<br />amended exhibit was submitted within the specified time frame, and resolution was confirmed by the Division in a letter
<br />of November 18, 1994.
<br />Stipulation 23 was placed on the permit as a result of RN-2 in February 1996. The stipulation required submittal of a
<br />revegetation plan modification to specify a woody plant density standard of 1000 stems per acre, or, alternatively, a plan
<br />that would include substantive modifications to enhance the utility of the reclaimed landscape for wildlife. The
<br />stipulation was resolved by TR-26, approved June 21, 1996.
