• . <br />Ponds, Impoundments and Diversions <br />Ponds, impoundments and diversions are discussed in Section VI - Surface Water <br />Hydrology of this document. These drainage facilities have been determined to <br />meet the design requirements of Rule 4.05. Information on the drainage and <br />sediment control plan is presented in Exhibit 7 and is shown on Map 7 of the <br />permit application. Across-section, plan view, and details of the pond <br />spillways are shown on Figure 8. Additional information on the pond and <br />ditches can be found in Section 2.05 (pages 2.05-20 to -23) of the permit <br />application. <br />The applicant is in compliance with the requirements of this section. <br />XX. Bonding - Rule 2.05.4(2)(b) <br />Information pertaining to performance bonding and reclamation cost estimates <br />is presented in Section 2.05.4 of the revised permit application. <br />As part of the preliminary adequacy review of the permit application, a <br />detailed evaluation of the estimated cost of reclaiming the La Plata #1 Mine <br />site was conducted by the Division, The applicant's initial estimate of <br />E30,000.00 contained no supporting calculations; therefore, the Division <br />prepared a preliminary estimate based on information from the reclamation plan <br />portion of the application and utilizing appropriate equipment costs, labor <br />charges, and hourly production rates from widely accepted cost reference <br />publications: The Division's preliminary estimate of E68,300.00 was forwarded <br />to the applicant on April 27, 1987, The applicant responded to this draft <br />estimate by providing some additional information regarding actual site <br />conditions and some clarifications as to specific requirements of the proposed <br />reclamation plan. The Division's preliminary estimate was subsequently <br />revised, resulting in a final acceptab]e bond amount of E58,200.00, <br />Pursuant to Rules 2.07.6(2)(3) and 3.02.1(1); a performance bond in the amount <br />of E58,200.00 will be filed with the Division, payable to the State of <br />Colorado, before a permit will be issued. The following stipulation is <br />required by the Division. <br />STIPULATION N0. 6 <br />A PERFORMANCE BOND IN THE AMOUNT OF 558,200.00, PAYABLE TO THE STATE OF <br />COLORADO, MUST BE FILED WITH THE DIVISION WITHIN FIVE (5) DAYS AFTER THIS <br />DECISION BECOMES FINAL. <br />With acceptance of the above stipulation, the applicant is in compliance with <br />the requirements of this section. <br />XXI. Sealing of Drill Holes and Underground Openings - Rules 2.05,4(2)(8) and <br />Information pertaining to the sealing of drill holes and the three open portal <br />entries at the mine is presented in Sections 2.05.4 (pages 2.05,4-29 through <br />-32) and 4.07 (page 4.07-1) of the permit application. <br />_P8_ <br />
