<br />Each portal and ventilation entry will be permanently sealed by constructing a <br />twelve inch thick solid block wall within each opening at a distance from the <br />surface where overburden height is three times the height of the opening. The <br />block wall will be keyed twelve inches into the floor and ribs of the entryway <br />followed by backfilling with twelve feet of common fill material. <br />A single drill hole currently exists at the mine site in the draw west of the <br />facilities area and is used as a water well. The applicant has committed, on <br />page 4.07-1 of the permit application, to seal the water well by welding a <br />steel cap onto the casing when the well is no longer in use. However, in <br />order to comply with the requirements of Rule 4.07.3(2), the well will need to <br />be sealed using cement or other suitable sealant by placing the sealant in the <br />hole from the bottom to within 10 feet of the surface. Therefore, the <br />following stipulation is required. <br />STIPULATION N0. 7 <br />WITHIN FIVE (5) DAYS OF THIS DECISION BECOMING FINAL, LA PLATA COAL <br />CORPORATION MUST REVISE THE PERMIT APPLICATION TO INCLUDE A COMMITMENT TO SEAL <br />THE WATER WELL LOCATED IN THE DRAW IMMEDIATELY WEST OF THE FACILITIES AREA IN <br />ACCORDANCE WITH THE REQUIREMENTS OF RULE 4.07.3(2). <br />With the acceptance of the above stipulation, the applicant is in compliance <br />with the requirements of this section. <br />XXII. Subsidence - Rules 2.05,6(6) and 4.20 <br />Information pertaining to subsidence is presented in Sections 2,05 <br />(pages 2.05-59 to -62) and 4,20 (page 4.20) of the permit application. <br />La Plata Coal Corporation has conducted a pre-mining survey of the proposed <br />permit area. This survey has demonstrated that no renewable lands overly the <br />La Plata No. 1 Mine. <br />As the surface expression of subsidence features has been observed at nearby, <br />abandoned coal mines, La Plata Coal Corporation has committed to establishing <br />and monitoring four monuments overlying the proposed mining operation. These <br />monuments will be surveyed twice a year, with the data being submitted to the <br />Division subsequent to each survey. <br />The applicant is in compliance with the requirements of this section. <br />XXIII, Special Categories of Mining Other Than AVF and Prime Farmland - <br />Rules 2.06, 4.22, 4.23, 4.26, 4.27, 4.28 and 4.29 <br />The applicant does not propose concurrent surface and underground mining, <br />auger mining, mountaintop removal, off-site coal processing plants or support <br />facilities, in-situ processing, experimental mining practices, or variances <br />_P9_ <br />
