F. Rule 3.03.2(1)(d) Determination of Completeness <br />• Upon submission of the proof of publication, the Division shall, within 10 days of receipt, review the <br />application and determine if it is complete. The Division shall notify the operator of its decision within <br />said 10 day period and if deemed incomplete, the operator shall be given the opportunity to amend, <br />review, or otherwise make said application complete. <br />The Application was deemed complete on December 5, 1997, upon correction of errors within, and <br />proof of publication of, the applicant's public notice. The Application was initially deemed <br />incomplete on September 30, 1997, as proof of publication of the applicant's public notice had not <br />been submitted to the Division. The applicant was advised that such proof of publication of the <br />advertisement was required before the Application could be declared complete, and the applicant <br />was advised of errors in the public notice, by Division letter of October 1, 1997. The proof of <br />publication of a corrected copy of the public notice (facsimile, dated 11/11/97, a State government <br />holiday) was received at the Division on November 12, 1997. <br />IV. PROCEDURES FOR OBJECTIONS (to the Application) <br />A. Rule 3.03.2(3) Objections to Requested Release <br />Any person with a valid legal interest which might be adversely affected by release of the bond, or any <br />Federal, State, or local government agency which has jurisdiction by law or special expertise with respect <br />to any environmental, social, or economic impact involved in the operation, or it authorized to develop <br />and enforce environmental standards with respect to such operations, shall have the right to file written <br />objections to or comments upon the requested release from bond and file a request for an informal <br />conference with the Division within thirty (30) days of the last publication of the notice (of the request <br />for bond release), or within thirty (30) days of the completed inspection, whichever is later. Upon receipt <br />of any such objection or comments, copies thereof shall be transmitted to the permittee. <br />The date of last publication of the notice of the request for bond release was October 29, 1997 (see <br />Document 1, Affidavit of Publication). The deadline for comments in reference to the notice was <br />November 28, 1997. The completed inspection was held on December 22, 1997. The deadline for <br />comments in reference to the inspection was January 21, 1997. No comments, written objections, <br />or requests for an informal conference regarding the bond release Application were received by <br />the Division in response to the public announcement. Oral comments were received during the <br />inspection of December 22, 1997. These comments were made in the presence of a representative <br />of the permittee, and are summarized under Paragraph V. No written objections, comment, or <br />requests for an informal conference were filed with the Division during or subsequent to the <br />inspection. Further, no informal conference was requested to resolve any objections as of March <br />23, 1998, the day that evaluation of the Application was considered complete (last adequacy issues <br />were resolved by Colowyo letter of March 12, 1998, received at the Division on March 16, 1998). <br />16 April 27, 1998 <br />
