B. Rule 3.03.2(4) Informal Conference on Objections to Requested Release <br />• Without prejudice to the rights of any person who might be adversely affected, the permittee, or the <br />responsibilities ofthe Division pursuant to this Rule, the Division shall hold an informal conference as <br />provided in 2.07.3(6) to resolve any written comments or objections on the request for release, when <br />such a conference is requested. <br />No written comment on, no objection to, and no request for an informal conference regarding, the <br />release was received by the Division as of April 27, 1998, the date the Division completed its <br />comprehensive evaluation of the request. <br />V. OBSERVATIONS AND FINDINGS [of Inspections and Evaluations by the Division (Rule <br />3.03.2(2)] <br />Upon receipt of a complete request for the release of a performance bond fire Division shale within thirty <br />(30) days or as soon thereafter as the Division determines weather conditions permit, conduct an <br />inspection and evaluation of the reclamation work involved. Such evaluation shall coruider, among <br />other things, the results of inspections and monitoring conducted pursuant to 4.05.13 and 5.02, the <br />degree of difficulty to complete any remaining reclamation, and whether pollution of surface or <br />subsurface water is occurring., the probability of future occurrence of such pollution, and the estimated <br />cost of abating such pollution. The written results of such inspection and evaluation shall be made <br />immediately available for public inspection in the offices of the Division. 'As soon thereafter as weather <br />conditions permit" means that the Division must be able to evaluate properly the reclamation operations <br />alleged to have been completed and, therefore, may be subject to seasonal limitations. The surface <br />owner and agent or lessee, if any, shall be given reasonable notice of such inspection, and may <br />participate with the Division in making the inspection. The Division may arrange with the permittee to <br />allow access to the permit area, upon request by any person with an interest in bond release, for fire <br />purpose of gathering information relevant to the proceeding. <br />The Division scheduled, and conducted, on December 22, 1997, an inspection of the reclamation <br />work involved. By letters of December 10, 1997, the Division invited the Bureau of Land <br />Management, the Office of Surface Mining, and the Colorado State Land Board to accompany the <br />Applicant and the Division on the inspection. No other agencies expressed an interest in the <br />process in response to the Applicant's public notice. Ms. Janet Hook, a representative of the <br />Bureau of Land Management, stated (by telephone) that she was familiar with the reclamation at <br />the site and was not planning on accompanying the inspection. Ms. Beverly Rave, a representative <br />of the State Land Board, James A. Kiger, of Colowyo, and Byron Walker and Daniel Hernandez <br />of the Division, attended the inspection. Ms. Rave expressed satisfaction with the process and the <br />reclamation. A written report of the inspection (Colorado Division of Minerals and Geology Coal <br />Inspection Report, Colowyo Coal Mine, C-81-019, 12/22/97) was immediately placed on file at the <br />offices of the Division for public inspection. Mr. Mitch Rollings, of OSM, later stated by telephone <br />that he had been unable to attend the inspection. <br />17 April 27, 1998 <br />
