Colowyo has a third surety bond on file with the Division that applies to resource <br />confirmation drilling within the Permit area. These areas of drilling are not applicable to the <br />Application. <br />The advertisement stated that only release of liability is requested for the areas subject to the bond <br />release. <br />The advertisement cited backfilling, regrading, topsoiling and reseeding during the period 1987 - <br />1995. <br />The advertisement stated that the status of reclamation is consistent with the requirements of the <br />approved reclamation plan. <br />The advertisement stated that requests for a public hearing or informal conference concerning this <br />bond release Application should be addressed to the CDMG. <br />The advertisement gave the address of the Division as Colorado Department of Natural Resources, <br />1313 Sherman Street, Room 215, Denver, CO 80203. <br />• The advertisement stated that comments, objections, and requests must be received within 30 days <br />of the last date of the publication, or within 30 days of the completed inspection by the Mined Land <br />Reclamation Division (a misnomer). The last date of publication was November 18, 1997. The <br />Division completed its inspection(s) on December 22, 1997. <br />E. Rule 3.03.2(11(c) Proof of Publication <br />Within thirty (30) days after the last publication required in (b) [Rule 3.03.2(1)(b)] above, the permittee <br />shall submit to the Division proof of such publications. <br />Colowyo Coal Company published notice of the bond release Application in the Craig Daily Press <br />once weekly for four consecutive weeks, beginning October 8, 1997 and ending October 29, 1997. <br />The Application was not received with a proof of publication of the public notice. The applicant <br />was so advised by Division letter of October 1, 1997.
