D. Rule 3.03.2(1)(b) Copy of Advertisement
<br />As part of the bond release request, the permittee shall submit a copy of an advertisement to be placed
<br />by the permittee at least once a week for four successive weeks in a newspaper of general circulation in
<br />the focality of the surface coal mining operations. Such advertisement shall contain a notification of
<br />the precise location of the land affected, the number of acres of land for which the bond release is
<br />sought, the name of the permittee, permit number and date approved, the type and amount of the bond
<br />filed and the portion sought to be released, the type and appropriate dates of reclamation work
<br />perfom:ed, and a description of the results achieved as they relate to the permittee's approved
<br />reclamation plan. The advertisement sltall also state that wriuen comments, objections, and requests
<br />for a public hearing or informal conference may be submitted to the Division; provide the address of
<br />the Division; and give the date by which said comments, objections, and requests must be received.
<br />The permittee complied with the requirements of Rule 3.03.2(1)(b). A copy of the public notice
<br />was included with the Application. This notice was corrected by the applicant in response to a
<br />Division review prior to publication.
<br />Areas first identified in the Application were the W'/z Sec 16, W'/z Sec 15, major portions of Sec
<br />11, NEl/a Sec 10, Nl/z Sec 4, SWl/4 Sec 3, and SWl/4 Sec 2, T 3 N, R 93 W; and Sl/z Sec 33, T 4 N, R
<br />93 W; all of the 6`h P.M. Changes were recommended by Division letter of October 1, 1997,
<br />whereby Wl/z Sec 16 was changed to El/z Sec 16, Nl/z Sec 4 was changed to read NE'/< Sec 4, SWl/<
<br />Sec 3 was changed to read Major Portions of Sec 3, and Sl/z Sec 33 was changed to read SE'/4 Sec
<br />• 33 to correctly locate the areas.
<br />A corrected copy of the advertisement placed by Colowyo in the Craig Daily Press was received at
<br />the Division on November 13, 1997, under a Colowyo letter of November 11, 1997. The
<br />advertisement included the precise location of the land(s) affected [E'/z Section 16, Wl/z Section
<br />15, Section 11 (major portions), NE'/3 Section 10, NE'/~ Section 4, Section 3 (major portions), and
<br />SW'/< Section 2 of Township 3 North, Range 93 West of the 6th P.M.; and the SE'/< Section 2 of
<br />Township 4 North, Range 93 West of the 6th P.Ivf]. The public notice cited the revised description
<br />of areas that include the polygons drawn on Exhibit 1, 1997 Bond Release Application dated 8/5/97,
<br />certified by a professional engineer on October 29, 1997 (a change from September 24, 1997).
<br />The notice cited 743.2 acres as the acreage to which the bond release pertained. During evaluation
<br />of the Application, the acreage was reduced to 712.1 acres (Colowyo letter, March 12, 1998).
<br />The advertisement stated that the Application was submitted by Colowyo Coal Company L.P.
<br />The advertisement cited permit number C-81-019.
<br />The advertisement cited November 5, 1992 as the date of the latest permit renewal. During the
<br />processing period of the Application, the Permit was renewed for a third time effective November
<br />. 14 April 27, 1998
