River Water Conservation District. A telephone call was placed, and returned by Phil Eggleston <br />on November 18 ,1997, of the Upper Yampa River Conservancy District. Mr. Eggleston informed <br />the Division that the Colowyo Coal Mine is outside their district. A call was placed, and returned <br />by Ann Brady on December 1, 1997, of the Rio Blanco Water Conservancy District. Ms. Brady <br />informed the Division that the Colowyo Coal Mine is not within the Rio Blanco Water Conservancy <br />District. A call was placed to the Yellow Jacket Water Conservancy District, Mr. Frank G. Cooley, <br />on November 18, 1997. Mr. Cooley indicated he wanted a notice. A call was placed to Mr. ICiger <br />to provide notice to the Yellow Jacket Water Conservancy District on November 18, 1997. A copy <br />of the letter to the Yellow Jacket Water Conservancy District was received at the Division by <br />facsimile on November 18, 1997. <br />B. Division Letter, December 12, 1996, Bond Release Applications <br />As the mine is a "Federal" mine, a copy of the Application is required to be sent to the United <br />States Office of Surface Mining per a 1997 OSMBLM/CDMG agreement. ("Federal" means that <br />either the coal to be mined is Federally owned, the surface within the permit area is Federally <br />managed, or both.) <br />Within the Application, the Applicant indicated that a copy of the Application had been sent to <br />Mitch Rollings, OSMRE, Denver, Colorado. <br />C. Rule 3.03.2(1)(a) Copy of Notice to the Division <br />• Copies of the above written notices [required by Rule 3.03.2(1)] must be submitted to the Division <br />within (30) days of the filing of the request for release. The petmittee is encouraged, however, to file <br />these copies with the request to avoid any unnecessary inspections under 3.03.2(2) and delay. <br />The permittee complied with the requirements of Rule 3.03.2(1)(a). Copies of the letters of <br />notification identified in section III.A above were received at the Division on December 4, 1997, <br />under Colowyo letter of December 1, 1997. <br />With the exception of the notice to Northern Coal Company and to the Yellow-jacket Water <br />Conservancy District, an example copy with a distribution list was provided within the Application. <br />A copy of the notice to the Northern Coal Company (Enron Energy Co.) was received in the <br />Division by facsimile on November 13, 1997. A facsimile copy of the notice to the Yellow-jacket <br />Water Conservancy District was received at the Division on November 18, 1997. On November 2~, <br />1997, by telephone, and by letter of November 26, 1997, Colowyo was advised that copies of the <br />(other) written notices above were required by the Division [Rule 3.03.1(1)(a)]. Copies of the <br />notices were received at the Division on December 4, 1997. <br />13 April 27, 1998 <br />
