A review of Division files showed that Costilla County had not been issued an open <br />burning permit for the fire. <br />4. Division files also contain documentation of the following events: <br />• February 3, 1991 -Open burning observed at Costilla County's San Luis landfill by <br />Ms. Turner. <br />• March 5, 1991 -Warning letter regarding open burning sent to Chairman Ernest <br />Chavez of the Costilla County Board of Commissioners. <br />• September 29, 1992 -Seven letters were sent to Maclovio F. Gallegos, Costilla <br />County Administrator, by the Hazardous Materials Waste Management Division of <br />the Colorado Department of Health. The letters detailed areas of noncompliance, <br />including open burning, at the Fort Garland, San Luis, San Francisco, Chama, <br />Garcia, Mesita and San Acacio Landfills in Costilla County. <br />• September 29, 1994 -Citizen complaint alleging open burning taking place at the <br />Fort Garland Landfill. <br />• January, 1995 -Complaint from a citizen alleging that open burning had been taking <br />place at the Fort Garland Landfill for several days. Regular burning started 1 112 <br />years ago when other county landfills had closed. Children had not been able to <br />practice ball in Fort Garland because of the acrid smoke. The community also has <br />many elderly and asthmatic persons. <br />• January 26, 1995 -Warning letter regarding open burning sent to Floyd Espinosa, <br />Chairman, Costilla County Board of Commissioners. <br />• February 7, 1995 -Telephone call from Chairman Espinosa to Millie Turner. He <br />asked if the Division would allow Costilla County to burn at the Fort Garland one <br />day a week or one day a month. <br />5. Based upon the information gathered, the open burning was conducted as part of the <br />commercial activities of Costilla County . <br />6. On November 1, 1495 a notice of violation was sent to Costilla County for violating <br />Section 25-7-123(2)(a), C.R.S. and Colorado Air Quality Control Commission Regulation No. 1 <br />Section I[.C.I. <br />Page 2 <br />
