<br />COMPLIANCE ORDER AND ASSESSMENT OF CIVII. PENALTY <br />IN THE MATTER OF COSTILI,A COUNfY BOARD OF COMMISSIONERS <br />7. On November 20, 1995, a Notice of Violation conference was held at the Division office. <br />8. Mr. Epi Jaramillo, Costilla County Commissioner and Mr. Robert Vasquez, Costilla <br />County Administrator were present at the conference representing Costilla County . Mr. Harry <br />Collier, Ms. Millie Turner and Ms. Jute Wrend represented the Division. <br />9. Mr. Jaramillo stated that it was difiicu{t for the county to prevent the accidental <br />igniting of waste material at the landfill. Most of the fires at the landfill were caused by the disposal <br />of still smoldering ashes from residential waste barrels. Once the fire starts burning deep in the <br />waste pit, ordinary firefighting tactics such as water cannot put the fire out. <br />10. Mr. Jaramillo also stated that the Costilla County intended to close the Fort Garland <br />Landfill because it does not meet the CDPHE Hazardous Materials and Waste Management <br />standards for a waste disposal site. The county has applied for a grant from the Colorado <br />Department of Local Affairs to build a transfer station at Fort Garland. The compacted waste will <br />be taken to the regional landfill near Del Norte for final disposal. <br />11. No evidence to refute the alleged violation was presented by Costilla County . <br />Il. CONCLUSION OF LAW <br />The open burning without a permit conducted by Costilla County on October 17, 1995 is <br />a violation of section 25-7-123(2)(a), C.R.S. and the Colorado Air Quality Control Commission <br />Regulation No. I, Section II.C.I. <br />III. ORDER <br />Based on the foregoing Findings of Fact and Conclusions of Law, and pursuant to sections <br />25-7-I IS (3)(b), and (c), C.RS., as amended, Costilla County is hereby ordered to comply with the <br />following requirements. <br />I. Effective immediately, Costilla County shall comply with section 25-7-123(2)(a) and <br />(b), C.R.S., as amended and the Colorado Air Quality Control Commission Regulation No. 1, <br />Section I[.C.l. <br />2. This Compliance Order shall constitute a final order of the Division. <br />Page 3 <br />
