FINDINGS OF FACT <br />1. This Compliance Order is issued as a followup to the October 17, 1995 investigation <br />of Costilla County 's open burning activities at the Fort Garland Landfill just south of the village of <br />Fort Garland in Costilla County, Colorado. The inspection was conducted by Ms. Millie Turner, <br />a duly delegated representative of the Colorado Department of Public Health and Environment. <br />2. The inspection was made pursuant to complaints received fiom area residents <br />regarding several open burning incidents that have taken place during the past year at the Fort <br />Garland Landfill. Ms. Turner observed a shallow trench about 200 feet long by 30 feet wide <br />containing smoldering trash. An attendant at the landfill directed Ms. Turner to Joe Ortiz at the <br />County shop in Fort Garland. Ms. Tumer contacted the county shop and spoke to a mechanic, Gene <br />Cordova, who stated that the fire had started on Saturday, October 14, 1995 as a result of someone <br />dumping hot ashes from a waste barrel. Ms. Turner spoke with Joe Ortiz on October 18, 1995 by <br />telephone. He said that the local fire department had attempted to put the fire out with water on the <br />day it started, but was unable to do so.
