PARTIES <br /> <br />Parties to this action are Montezuma County, the Applicant, and their permitting <br />agent, Southwest Land Services, Inc.; and Objector Eric Lindgren. <br />United States Department of the Interior, Bureau of Land Management, as surface <br />owner, has been identified as an interested agency, but is not a party to this action. <br />All parties except Montezuma County, Southwest Land Services, and Eric Lindgren, <br />attended the Pre-Hearing Conference on November 9, 1998, and their addresses, <br />telephone numbers and FAX numbers are set forth in Attachment A. <br />III. ISSUES TO BE CONSIDERED <br />1. Did the applicant provide notice to adjoining landowners in time to allow public <br />comment prior to the close of the public comment period? <br />2. Did the applicant's notice to adjoining landowners provide sufficient description of <br />the operation? <br />IV. ISSUES NOT TO BE CONSIDERED <br />The Pre-Hearing Conference Officer determined that the following objection issues <br />are not within the jurisdiction of the Board, and therefore, will not be considered during the <br />formal public hearing. <br />1. Will there be any limits on the scale of the proposed operation? <br />The Pre-Hearing Conference Officer determined that this issue is under the <br />jurisdiction of the County Planning Department. <br />2. Will the negative impacts of noise pollution be mitigated? <br />The Pre-Hearing Conference Officer determined that this issue is under the <br />jurisdiction of the County Planning Department. <br />3. Will the negative impacts of truck traffic be mitigated? <br />The Pre-Hearing Conference Officer determined that this issue is under the <br />jurisdiction of the County Planning Department and Colorado Department of <br />Transportation. <br />-2- <br />
