The applicant is in compliance with this rule. The date <br />of last publication was October 20, 2000. Proof of publication was submitted to the Division on <br />November 10, 2000. <br />Rule 3.03.2(1)(d) The application is in compliance with this rule. <br />Upon submission of the proof of publication, the Division shall, within 10 days of receipt, review <br />the application and determine if it is complete. The Division shall notify the operator of its decision <br />within said !0 day period and if deemed incomplete, the operator shall be given the opportunity to <br />amend, review, or otherwise make said application complete. The proof of publication was received <br />by the Division on November 14, 2000 (hard copy). The application was determined to be complete <br />on November 21, 2000. <br />Rule 3.03.2(2) The application is in compliance with this rule. See the Rules for the contiguous text <br />of this rule. <br />Upon receipt oja complete request for the release of a perfonttattce bond the Division shall, <br />within thirty (30) days or as soon thereafter as the Division determines weather conditions <br />perntit, conduct an inspection and evaluation of the reclarruuion work involved. The Division <br />received a complete request for release on November 14, 2000. However, snow cover on the area <br />and winter conditions delayed the inspection until spring (see Division letter of November 22, <br />2000). The inspection was conducted on June l9, 2001. Evaluation of the reclamation work <br />involved started upon receipt of the application, and continued through the consideration of <br />inspection findings. Written results (19 June 2001) of the inspection and evaluation of the <br />reclamation work involved aze attached and on file at [he Division for public review.
