<br />r Bradford Janes - 2 - February 2, 1990 <br />' Exhibit D - Mine Plan <br />' In order for the application to be consistent with Rule 2.1.2(5)(e) and to <br />insure that the operator will be able to comply with the stated future land <br />use and the applicable performance standards in Rule b of the Mineral Rules <br />1 and Regulations, please provide the following: <br />1. Under "Orientation" reference is made to a portion of permit M-78-12 <br />' being included in this conversion "as indicated on Exhibit C-1, Plat 1; <br />Affected Lands Map." No indication or reference to Permit M-78-12 could <br />be found on Exhibit C-1, Plat 1, please revise as appropriate; <br />2. "Current Conditions" The text of this section, as well as Exhibit C-1, <br />Plat 1; appear to infer that areas of pre-law disturbance may be exempt <br />from current reclamation"requirements. Any areas which have been <br />redisturbed or utilized since the issuance of permits M-78-011 or <br />M-78-012 must be reclaimed according to the appropriate provisions of the <br />Act and rules and regulations. To clarify the status of the disturbed <br />' areas, a map should be provided which identifies all areas within the <br />proposed new permit area which have been mined or otherwise disturbed <br />since the issuance of Permits M-78-011 and M-78-012; <br />' 3. There is no discussion of surface ar groundwater control in the <br />application. Exhibit G merely states that the ,operator is not expected <br />to affect surface or groundwater systems, and in item 17 of Exhibit D - <br />Mine Plan which states that a diversion will be created above the <br />finished slopes to route upslope surface drainage to an established <br />drainageway. In order to clarify potential impacts to the hydrologic <br />' regime, please address the following: <br />a. Does the operator expect to encounter any groundwater during the <br />excavation of the pits? If not, what information was utilized to <br />draw this conclusion? <br />b. If groundwater is encountered, what measures will be taken to <br />' prevent surface or groundwater quality degradation? <br />c. Several surface drainages tributary to Bijou Creek flow through the <br />proposed permit area. Will any flow over the disturbed areas reach <br />' these tributaries? Describe the control measures which will be <br />taken to protect these tributaries? <br />d. Will surface water flows enter the planned pits? If so, will the <br />water be pumped out? How would the pumped water be disposed of? <br />Pursuant to C.R.S. 34-32-117(g), please demonstrate how surface <br />' water quality will be protected during the operation and when pit <br />areas are dewatered following precipitation and runoff events. <br />e. Please provide the construction specifications, including cross <br />sections and flow calculations for the upslope diversion channel. <br />All permanent diversions must be sized to safely convey flows from <br />the 100 year, 24 hour storm event. <br />
