<br /> <br />• Response: The existing permit document reflects revisions under several different operators <br />and organizational schemes over a period of twenty years with resulting organizational <br />inconsistencies. Both Roman numerals and lower-case letters have been used to designate <br />revised pages. Because lower-case letters are easier to understand, this convention has been <br />adopted for this and future revisions. To clarify the placement and sequencing of <br />replacement permit pages across-reference list is provided with these responses identifying <br />each replacement page and the page it is replacing. Where replacement pages fall within a <br />sequence of previous revision pages which use the Roman numeral convention, the entire <br />sequence has now been revised for consistency using the lower-case lettering convention. <br />Please see accompanying revisions. <br />Oxbow has discussed the possibility of rewriting and reformatting the existing permit to <br />both conform with the current regulatory structure and eliminate formatting <br />inconsistencies. This effort would, however, involve significant work and cost. If Oxbow <br />elects to proceed with a permit rewrite it would be logical and more cost effective to <br />complete the rewrite in conjunction with permit renewal and/or a contemplated future <br />permit revision for development of the D-Seam nursing area to minimize duplication of <br />work. <br />2.03.10 Identification of Other Licenses and Permits <br />5. On numbers two and three, please change the Colorado Department of Health to read, Colorado <br />Department of Public Health and Environment. <br />• Response: The specified permit designations have been corrected as noted. Please see <br />accompanying revisions. <br />6. Has the "404 Permit to extend Elk Creek Culvert" been approved? !f so, please provide the <br />approval documents. If not, provide the documents when available. <br />Response: The initial 300-foot extension of the Elk Creek culvert has been approved by <br />the U.S. Army Corps of Engineers (COE) under Permit 199675449 and by Gunnison <br />County under a 4/7/97 "No-Impact" determination. A Section 404 Permit Application for <br />an additional 350-foot extension of this culvert and the ephemeral channel disturbance <br />associated wi[h cons ruction of the West Valley Fill was filed with the COE (Grand <br />Junction Office) on 4/16/97. Approvals for the additional disturbance were issued under <br />COE Nationwide General Permit Number 26 as a modification to the existing approved <br />Permit 199675449 on 5/28/97. A copy of the permit approval accompanies these responses <br />for insertion in Appendix R, Other Permits and the discussion of other licenses and permits <br />(Section 2.03.10) has been updated accordingly. Please see accompanying revisions. <br />2.04.7 Hydrology Description <br />2.04.7(2)(a)Surface Water Information <br />7. In paragraph two, it states that "the diverted water is returned to the river."
