<br />The gas well located near Phase 7 will not be adversely affected <br />due to the extraction of gravel near the site. It is planned <br />to stay away far enough to maintain its stability. At this <br />time, the ownership of the well is in litigation due to <br />bankruptcy of the owner and the actual preparation for <br />abandonment of the well~has commenced. we have been informed <br />that the well was a low producer and is in sufficient state <br />of disrepair from lack of maintenance that almost a complete <br />wellhead would have to be constructed before the site was <br />operable. It may be that we will request enlargement of the <br />mining area to include the well site at some future date if <br />the entire well site is abandoned. The area of concern about <br />the existing gas line being moved or an agreement to do so should <br />the line be disturbed can be clarified by the fact that mining <br />in that area has taken place and no adverse affects have <br />apparently occurred to either the well or the gas line. This <br />also applies to the house, barns and storage area. Any man-made <br />structures within 200 feet of the affected mining areas are <br />the property of Gosney and Sons. Mining will not occur in a <br />close proximity to any of these structures so as to affect <br />the stability of said structures. <br />The two residences to the north of the property boundary and <br />permit boundary are well outside of the actual affected mine <br />area, as indicated on the clarification map. The area between <br />the affected mine area nd the permit boundary may contain an <br />access road at some time. <br />MINE PLAN DETAILS <br />Gosney and Sons, Inc. does the majority of the gravel mining <br />during the months of March through September due to the winter <br />weather conditions that exist in Southwestern Colorado. They <br />do continue to work, when the conditions permit, during the <br />winter months, especially when demand is high and the need to <br />stockpile inventory exists. The hours of operation Gosney and <br />Sons have agreed to abide by are Monday through Saturday, 7 <br />AM to 6 PM with emergency hours from 5 AM to 9 PM Sunday <br />operations can occur with one day of bad weather or equipment <br />breakdown within the previous week. There are no working <br />schedule restrictions concerning months with the County permit, <br />which is a county land use permit, not a special use permit. <br />RECLAMATION PLAN DETAILS <br />In Phases 5, 6 and 7, we expect to encounter groundwater, with <br />the history of the pond to the south, but cannot be absolutely <br />sure of this. We originally wrote the reclamation plan to <br />include cost estimates for a permanent pond and the reclamation <br />thereof. We are attaching a reclamation scenario should the <br />pit turn out to be dry. <br />The drainage control structures at the site are the large pond <br />located to the south of Phases 5, 6 and 7 and the grading that <br />conducts drainage to the pond. These will be left on the site <br />after mining to continue controlling any drainage in the future. <br />The reclamation figures included reclaiming the areas surrounding <br /> <br />
