Rule 2.08.4(1) General requirements. A permit revision shall be obtained.•
Rule 2.08.4(1)(b) When required by an order issued under 2.08.3(3);
The permit findings identifies items that require a revision to the permit.
Rule 2.10. ] General Requirements
Maps of the permit meet the general requirements. However, this permitted activity is in a unique
situation. A major reconfiguration of surface facilities was permitted under TR-06 when the
permit was under temporary cessation. The permitted work has not been started. Thus there is
confusion between the maps and on-the-ground conditions. The operator is asked to resolve
this communication problem.
Rule 2.10.3(1)(a) All boundaries of lands and names of present owners of record of those lands,
both surface and subsurface, included in or contiguous to the permit area;
The application is not clearly in compliance with this rule. See Map 3-1, last revised March
2005. Easements are also shown.
Rule 2.10.3(1)(b) The boundaries of land within the proposed permit area upon which the
applicant has the legal right to enter and begin surface or underground mining activities;
The application is in compliance with this rule. See Map 3-2, last revised March 2005.
Rule 2.10.3(1)(c) The boundaries of all areas proposed to be affected over the estimated total life
of the proposed surface or underground mining activities, with a description of size, sequence,
and timing of the mining and subareas for which it is anticipated additional permits will be
sought;
The application is in compliance with this rule. See Map 17-1. The boundary is on a number of
maps. There are no areas for additional permits.
Rule 2.10.3(1)(d) The location of all buildings on and within 1, 000 feet of the proposed permit
area, with identification of the current use of the buildings;
The application is in compliance with this rule. See Map 12-1, last revised 5/25/00.
Rule 2.10.3(1)(e) The location ofsurface and subsurface manmade features within, passing
through, or passing over the proposed permit area, including, but not limited to major electric
transmission lines, pipelines, and agricultural drainage file fields;
The application is in compliance with this rule. See Map 12-1, last revised 5/15/00.
Page 27 of 38 pages, November 8, 2005
