"Compliance" documentation, those documents <br />that change on a time schedule, are on file at the offices of Hydro-Environmental Solutions, Inc., <br />57 10th Street, Suite B, Steamboat Springs, Colorado. <br />Rule 2.07.6 Criteria for Review of Permit Applications for Permit Approval or Denial. <br />There are no known changed conditions that would alter the considerations for prior approval of <br />the permit. <br />Rule 2.08.1(1) Revisions to and affirmative periodic review of permits previously issued by the <br />Division, <br />This is a midterm review of Permit C-1992-081. <br />Rule 2.08.3(1) The Division shall review each permit issued and outstanding under these rules <br />during the term of the permit. This review shall occur not later than the middle of the permit <br />term and as required by 2.06.2 through 2.06.7, pertaining to experimental practices, <br />mountaintop removal, steep slope, and combined surface and underground mining. <br />The permit does not pertain to experimental practices, mountaintop removal, steep slope, and <br />combined surface and underground mining. This is a review of permit C-1992-081. <br />Rule 2.08.3(2) For permits of longer than S year terms, a review of the permit shall be no less <br />than the permit midterm or every S years, whichever is more frequent. <br />The permit term is for 5 years. <br />Rule 2.08.3(3) After this review, the Division may, for good cause shown, by order, require <br />reasonable revision or modification of the permit provisions to ensure compliance with the Act <br />and these Rules. <br />The applicant is asked to update or revise portions of the permit as a result of this rule. <br />Rule 2.08.3(4) Copies of the decision of the Division shall be sent to the permittee. <br />A copy of the midterm review will be sent to the applicant, along with a letter requesting required <br />actions. <br />Rule 2.08.3(5) Any order of the Division requiring revision or modification of permits shall be <br />based upon written f ndings and shall be subject to administrative and judicial review. <br />The midterm review is in the form of a findings, and is based on this memorandum. <br />Page 26 of 38 pages, November 8, 2005 <br />
