The application is in compliance with this rule. A current air permission permit is at Attachment <br />C, Tab 22. <br />Rule 2.05.6(1)(b) All permit applications shall contain a description of the steps to be taken, <br />including copies of permits or permit applications, if any, to comply with other applicable State <br />or Federal air quality laws or regulations. <br />The application is in compliance with this rule. See Tab 22. <br />Rule 2.05.6(2) Fish and Wildlife Plan. <br />The application is in compliance with this rule. See Tab 21. <br />Rule 2.05.6(3) Protection of hydrological balance. <br />The application is in compliance, with the exception of points of compliance, with this rule. <br />See Tab14. <br />Rule 2.05.6(3)(b) The description shall include: <br />Rule 2.05.6(3)(b)(i) Aplan for control, in accordance with Rule 4, of surface and ground water <br />drainage into, through and out of the proposed permit area and adjacent area; <br />See Rule 4. <br />Rule 2.05.6(3)(b}(ii) A plan for treatment, where required by these Rules, and for surface and <br />ground water drainage from the area to be affected by the activities, and proposed quantitative <br />limits on pollutants in discharges subject to applicable State and Federal laws. <br />The application is in compliance with this rule. Two sedimentation plans treat surface runoff. <br />Rule 2.05.6(3)(b)(iii) Adetermination of the probable hydrologic consequences of the proposed <br />surface coal mining activities, or underground mining activities, on the proposed permit urea <br />and adjacent area, with respect to hydrologic regime and the quantity and quality of water in <br />surface and ground water systems under all seasonal conditions, as determined by baseline <br />hydrologic and geologic data collected from, or statistically representative of, the site. The <br />probable hydrologic consequences will identify adverse impacts which may occur to the <br />hydrologic balance including: impacts from acid- or toxic forming materials; whether the <br />operation would interrupt, diminish, or contaminate water sources; the effect the operation <br />would have on sediment yields, flooding or streamflow, and surface and ground water <br />availability; and the effect the operation would have on concentrations of total dissolved and <br />total suspended solids, total iron, pH, total manganese, and other parameters required by the <br />Division. <br />Page 23 of 38 pages, November 8, 2005 <br />
